HOWEVER (and it is a really really important however hence the big red letters)what they are legally entitled to do is to sue you for monies lost and any costs incurred. By monies lost this can mean the amount of money the vehicle didn’t earn by being stood plus any costs for bringing in an agency driver or sub contractor for the remainder of the duration of the length of notice you were required to give. In extreme circumstances if it meant they lost a contract because of it, they could sue you for the potential earnings that contract could have given them. If its a small firm and you leave on sour grapes then its likely they would do this.
Give in your notice. That way in the future the door is also not necessarily closed to you going back there if the need ever arises.
Conor makes a very valid point which should not be ignored.
Many responsible employers, when receiving Notice from an employee will carry out what is called an “Exit Interview”. It provides the employee with an opportunity to really tell the employer why they are leaving, who in the organisation is not pulling their weight, or is just plain arrogant or incompetent, or to explain what, for you as an individual, is not to your liking regarding the job.
You will no doubt have made friends where you are working and they may have similar misgivings as yourself but not have the flexibility to leave. The Exit Interview is your opportunity to also speak on their behalf and hopefully things get better for them.
Plus, everybody gets racked off and wants a change periodically. Providing you leave on good terms, there may be future opportunities to either return or obtain employment elsewhere working with managers that have themselves moved on.
Transport is a transient occupation. (corny or what ). Both drivers and managers tend to move around every few years and names of good workers stick in people’s minds. You never can tell, leave in a cordial fashion, and a few years down the line you suddenly get a phone call offering you your ‘ideal’ job.
Also remember that you may need a referance, even in the days of driver shortages.

i had that at longs of leeds when at a meeting chris long said no money in the pot you dont like leave…
so i did not like all them numptys still there cos their too frightened to leave
Well I did it, phoned them this morning I told them I will not be in I quit.
That,s 2 drivers lost this week.
I am sure some one on a previous post said that they have to pay you for any work done, notice or not.
Got a days agency work tomorrow, Pontypridd–Bristol–Wellingbrough then home, £8 per hour and £9 after 6pm, nice 8am start.

Thats the way I see it, I will go all the way to get my wages even if it costs me money to get them.
Treat drivers with a bit of respect and you will get some back.

They have to provide a written contract after one months service
If there is no contract then you would have an “implied contract”, and the notice period would more then likely be worked out on how frequently you were paid. I.e. paid weekly = 1 week notice, paid monthly = 1 months notice. But having said that if they did not give you a contract you would have it far easier if you needed to take them to court then they would.
As soon as they offer you a job and you accept thats a contract.
A weeks notice is specified in the law somewhere but I cant remember where. If your employer breaks the employment contract then the contract ceases to exist and you are not obliged to fullfill your side. If they tell you to break the law or endanger people you do not have to do it.
If you had been told to break the law and endager people I think this would have been a breach of contract and your refusal to go back to work to do this would be justified, and you should get paid.
If you just jacked without notice I think the employer may win.

ive not heard of any haulage firm ever taking a driver to court due to them jacking it and id say they probibly never will and if ure going to jack it go on the sick for a week that way u get ure money as most companys dont pay u when ure sick just stat pay plus putting the gaffer up against the wall and politly advising him to get his wallet out also works
