My manager has devised this new weekly rota for myself as he needs a hand sorting the yard out, my question to you guys is, is it legal ? and where do I stand regarding weekly rest ? e.t…c

Monday 5.30 - 16.30 about six hours driving involved (class 2).
Tuesday in yard (no driving) 5.30 - 16.30.
Wednesday in yard (no driving) 5.30 - 16.30.
Thursday in yard (no driving) 5.30 - 16.30.
Friday 5.30 - 16.30 about six hours driving involved (class 2).
Saturday 6.00 to 18.00 shunting.
Sunday Rest day.

If finishing at 18:00 on Saturday then you can’t start work till 15:00 on Monday, however you can take reduced weekly rest (at least 24 hours) but that must be compensated for by the end of the 3rd week following the week in question.

IE week one you’ll have 35.5 hours rest, on week four you’ll have to have 54.5 hours rest.

Also the 48 hours over 26 weeks average will quickly go up.

If this is gonna be a regular thing then your gonna fall foul of the regs.

Short answer; NO.

From the figures you have given I’ll assume that you do not take breaks on the days you are in the yard, in which case, your total working week is; 65 hours 30 minutes. Difficult that, as the absolute limit under WTD is 60 and the average must be no more than 48. Even if you allow an hour break on each none driving day, you still bust the maximum WTD limit, let alone the average limit.

You only have 35 hours and 30 minutes weekly rest between finishing on Saturday and starting on Monday. You need 45 hours, although every other week you may reduce down to no less than 24 consecutive hours. If you reduce weekly rest, you must compensate by ‘paying back’ an equivalent period, added to a daily or weekly rest, no later than the end of 3 weeks after the week the reduction occurred in. Your shift pattern doesn’t allow you to do this, the minimum you would need is 18 hours and 30 minutes, if you were to compensate 9 hours 30 on a 9 hour daily rest, you are only getting a daily rest period of 13 hours.

I think you might still be well over the ‘average’ 48 hour week but within the weekly rest period regs
It would help if you could break down each day a little further to include your rest periods/lunch breaks etc as it would show what hours are actually worked

As far as weekly rests are concerned you would be legal, you would be having a reduced weekly rest every other week and paying back the compensation the following weekend, no problems with that.

You probably would be over the maximum 60 hour week and the average 48 hour week depending on what breaks and POA you’re booking each day.
