Are people involved in this industry really that stupid these days. I would love to see the expression on VOSA mans face when he gets told this or discovers it. Even the worst of the cowboys would not actually tell you that. Roger is right. NO NO NO God almighty what next.

That actually sounds right mate. Add 13 hours driving to 11 hours rest and it gives you the 24 hour period. Then you can start another 24 hour period. Not sure how you questioed this, what did you actually think it was yourself?
Driving time is limited to 9 hours but can be raised to 10 hours twice a week
Duty time isn’t actually stipulated in the regulations … but daily rest is. In a 24 hour period from the end of your last rest period you must have an 11 hour daily rest which can be reduced to 9 hours 3 times a week.
Therefore as you say DRIVING then you are wrong. If you had said DUTY then you may be right.
That’s just my opinion though …

Make that 3 times between two weekly rest periods and you’re right

Yes but how much working time you could legally do depends on whether or not there’s a night time workers opt out agreement in place.
With no night time workers opt out agreement in place you can only legally do 10 hours working time in the 24 hour period from the start of shift, therefore if you wish to comply with the WTD night workers rules you can only do 10 hours working time from 21:00 Monday to 21:00 Tuesday.
So if you started at 21:00 Monday and finished 05:00 Tuesday having done say 7 hours working time (7 hours work plus 1 hour break) then re-started work at 14:00 Tuesday you could legally work until 17:00 but would then have to stop work until 21:00.
With a WTD night time workers limit opt out agreement in place there’s no problem.

that is subject to have a 9 hour rest available

ok now lets say i spent the whole time from 9pm-till 5am on poa, it is tesco after all lol would it still be the same as above?
im just checking i havnt made a huge error before xmas lol
POA does not count as working time nor can it count as daily rest so you would indeed be able to restart work after a 9/11 hour daily rest period, but you would still need to watch that you don’t go over the 10 hours working time in the 24 hour period from the start of the last shift.
braw, i should be fine then, only thing i can see wrong is the tacho not registering my breaks properly which it has done in the past. blooming hate digi tachos

what is it recording instead?
just sometimes its not recording the breaks properly, only with one firm though. and i always had my break at the depot so could put it on break and go to the canteen and gte breakie/lunch etc and come back 50 mins later
what does it actually record then - driving, other work, poa…?
