Is this right/legal?

while working for a firm last year, my HIAB ticket ran out, the firm put me through a refresher. passed that, then 4 months later i left.
now they kept my new ticket at company hq. now i could use my HIAB ticket again but the said company have refused to release it to the training firm, so i could get a copy. QUESTION IS, IS THIS RIGHT.
whilst i appreciate they paid for the refresher, i,m of the opinion that its my ticket regardless. i,m open to your opinions/views and to be corrected if my thinking is wrong… :wink:

When I worked for a company that required ADR,they put us through it,and it was refreshed every 5 years.

However,there was a catch…

You agreed to a 5 year write off period for ANY training they felt was necessary for the job,and after just short of 10 years,I left.The trouble was,I still had 3 years of my agreement to run,and they promptly seized the balance back,but the ADR certificate was mine.

thing is , i never signed anything tying me to any lenth of time etc etc, should of made that clear, :wink:

it’s just out of spite then as it’s no use to them - however if they paid for it and you can now use it should they expect some of the costs back like in quinny’s case?

Did they not give you a wallet copy of the licence to show on sites visited ?.
If not why not ?.
Whose name is the licence in ? as surely if it’s in yours then the training company needs your permission to release data held on you, not your former employers.
I would contact the training company & ask what data is held on you & why they are refusing to give you access to it.
Threaten them with the Data Protection Act if they refuse to communicate with you.
Possibly making life hot for the training company will make them more co-operative & result in them explaining why they are with holding information you have a right to under the DPA.

Ring up the people who did the refresher and ask them send you a copy of the certificate details then forward it to the people who issued the original licence (CITB or who ever) and ask for a new one. Failing that a one-day re-sit should cost you around £110. The ticket is yours and even if they paid for the retest it is still yours. Ring this CITB help line for more info 01485 577877.

This is a common attitude of companies that despises having to put you thru training or refresher courses because they a ■■■■ scared that once you have the update, you will leave them for better things.

1/ It is every employers duty to ensure that you are trained and competent do carry out your work.

2/ An employer cannot charge you the cost of health & safety items or training. (part of a HIAB course has a basic H&S qualification). Unless you signed a contract agreeing to pay them back then they cannot charge you for this. (Our company often asks you to pay the cost of a replacement ticket if you leave which is just crap!)

3/ If your ticket was issued by the CITB, CTA or CPCS then you will be able to contact them for a replacement ticket at a small cost. The ticket is in your name and is yours. You do not need your ex employers agreement to get it.

4/ If you joined the company with a valid ticket then the company has enjoyed the benefits of your qualifications at no expense to them. Therefore why not issue them with an invoice for the cost of HIAB training for the period you used your own ticket. I bet that would ■■■■ them off. :laughing: :laughing:

At the end of the day they are just bitter and twisted that you left them and they want to make life as hard as possible for you to continue driving HIAB’s. If they had treated you fairly then you would probably have never left in the first place.

I am continually amazed how large professional companies are happy to watch experienced hard working drivers/operators walk out the gate, rather than sit down and come to a happy medium. They would rather be left with the muppets than give in to the professionals.
