Is this ok shift to accept from agency?

I still would do some silly jobs to get experience but I need sleep before I do this and I know I will not get it, there is huge difference between hard day after night’s sleep and hard day without it, this is when it becomes too dangerous…

Whats the betting the agency would be charging a premium for the shift and not paying any if that to the op. They also wont be doing the prison time if yiu fall asleep and kill someone.

I think you’ve answered your own question as your saying you think you’ll be too tired. Dont risk it and stick to your guns

I’ve been doing a bit of agency work and they have asked me to do some shifts from a town 50 mins from my home. So innocently I ask do I get paid from the time I leave home and what about fuel. " Oh no you that’s down to you mate"
I can’t believe anyone would be so stupid to do this for an average wage.

  2. You need more than 2 hours sleep. Read the thread about fatigue - falling asleep driving a truck is horrifying. And for £100 is insanity.

  3. Unless you live in a void lacking in trucks never go that far for a job. My limit is 10 miles. And usually within 5 miles. To go any further I’d be wanting travel and petrol money on top of the job.

  4. Good on yourself for saying no. The more you stand up for yourself the better the jobs you will get. Be polite but say no to the crap work. Eventually you get offered stuff which is acceptable to you.

Yes, but under the WTD, as has been stated, 00:00 to 04:00 is classed as nightshift for the purpose of the rules, and as the op is starting his shift within that time frame, then that’s all that matters. (Unless the opt out is in place for shift duration, which you can guarantee the agency will say there is one with no proof to the op.)

I hope the op told them where to shove it if he was tired.

The agency can say whatever they like (and, believe me, they will) but anything that goes through the hours between 00:00 and 04:00 is night shift

As was posted before, night shift is a maximum of 10 hours unless they got you to opt out of it

Whether he has personally agreed to the opt-out is irrelevant. What matters is whether there is a collectively agreed opt-out in place at the depot in question. If there is (and the fact it appears to be a regular run suggests that’s the case) then the 12 hour shift is OK.

The Working Time Directive says different. Under the Working Time Directive any shift where you’re working even a single minute between the hours of 00:00 and 04:00 is treated as a night shift. So whilst their pay rules may class it as a day shift, for the purposes of the WTD and the 10hr limit it is classed as a night shift. However I would expect there’s a workplace agreement in place to opt out of the 10hr limit.

Stupid o’clock start times are only any good if you are in a routine of doing them, or at have least had a day or so to get yourself ready for it. Subjecting yourself to a 2am alarm & 3.30am start out of the blue will only land you behind the wheel without having had enough sleep, period. Your sensible not to do it.

I used to do 3am starts regular for a good while & honestly look back and don’t know how I did it. It’s a lifestyle change doing them start times. Never understood why drivers seem to like doing daft o’clock starts so much, finishing early is all well and good but then if you need to be in bed at 7am to get a decent kip then you may as well work a back shift.
