Is this legal?

Just an example:

– finished full week rest –

Day – Start — Finish
Mon – 01:00 – 15:45
Tue – 01:00 – 15:45
Wed – 01:00 – 15:45
Thu – 01:00 – 13:45
Fri – 01:00 – 13:45
Sat – 01:00 – 15:45

– start weekly rest –

Can this driver work the Saturday legally given that he has had already 3 daily rest reductions on the Monday, Tuesday and Wednesday.

I understand that a driver can reduce his/her daily rest 3 times between daily rest periods but does the Saturday reduction also count as a daily rest?

Not legal, the Saturday still counts as a reduced rest even if you go straight into a weekly rest after it.

That is, assuming none of the four days over 13h duty include an uninterrupted 3h break. If one (or more) of them does, that day doesn’t count as a reduced rest as you’ve had a “split daily rest”.

Easy way to work this out is to remember you can work more than 13 hours three times between weekly rest periods. Then look at the example you have posted and count how many times the driver has gone over 13 hours, if the answer is more than three then it isn’t legal.

You extend a daily rest period into a weekly rest period so the rules regarding daily rest apply just as much on the last shift before a weekly rest period as on the first shift after a weekly rest.

Thank you both.
