Is this legal under WTD?

Start work at 6 am, total drive time one hour and 50 minutes, other work for the rest of it, go on 16 minute break at 11.59.

Work another 20 minutes, (a couple of minutes driving and the rest other work) then end shift?

Think you need half hours worth of breaks if you’re between 6 and 9 hour shift. Could be wrong like.

It’s legal for the 6 hour rule but not for the total amount of breaks required in the shift.

Looks like you’ve done a total of 6 hours 19 minutes working time.

As said above a total of between 6 and 9 hours of working time requires total break/breaks of 30 minutes.

If the digicard hasn’t been used since that shift, it might not be an infringement, if they remembered another 15min break and a little other work before daily / weekly rest, when the manual entry is made.

On the other hand if they didn’t have another 15 break, as stated above, would be a wtd infringement.

Way I think it works as said shift upto 6 hrs need 15 mins break over 6 hours need a second 15 mins. Say you work 4 hrs take 15 then work 3 hours and done for the day taking your week daily rest.
It thinks you’ve worked 7 hours only had 15 mins break as it can’t tell recognise you as having a weekly rest and or a break

So basically if happens what do before you finish take another 15 mins break change tacho to bit of other work for couple mins then back to rest for your daily rest.

For shifts that do not exceed 6 hours working time you do not legally need a break for the working time regulations.

If the shift has more than 6 hours working time but not more than 9 hours working time you need a total of 30 minutes break.

If the shift has more than 9 hours working time you need a total of at-least 45 minutes break.

For the working time regulations breaks can be taken in 15 minute segments.

Breaks and POA do not count as working time.

Obviously this is not taking into consideration driving breaks.

hence why or otherwise some companies shift times run from 6am to 15:30pm 9 hrs work with a 30 min break

The one I didn’t know is you can take a 15min break at say 11:45 you can then work till 12:15.

For WTD then yes.
Drivers hours …is a different question and different legislation.

If you have a 15 minute break from 11:45 to 12:00 you can then work until 18:00 before needing another break for the working time regulations 6 hour rule.

That is of course assuming you don’t reach 41/2 hours driving time.

It’s just on the odd occasion when I, I mean my friend, only does six hours there is no need for a break at all, as long has he hasn’t exceeded four and a half hours driving, but some advice says 15 minutes for six hours work, (which is not strictly true) then 30 minutes for six to nine hours work, which is a bit confusing.
