My mate who used to work with me went back to his old job a couple of years ago. a job was coming up doing the planning so as he wanted to come off the road he asked if he could have the job. boss told him to apply like everyone else which he did so, didnt get interview when he asked why he didnt even get a look in boss said that there was no one and no time to show him what to do. so he carries on with his job couple of months later a driver is in the office getting trained up, no application/interview just straight in.would you say this is fair and also a case of discrimination?
No, it’s favouritism.

You really don’t want to get started on that whole discrimination thing. You would have to firstly show which of the 9 protected characteristics under the equality act he falls. Then show he has suffered a disadvantage and even then it could still be proportionate means of achieving a legitimate aim… Need I go on 
discrimination is a mine field and pretty much impossible to prove especially in the circumstances you state…
did this other driver apply for the original post? is it possible that he did and as been taken on at a later date? when your mate applied did he do it like he would when applying for a job elsewhere?
alot of large places now expect you to sell yourself to them like you have never worked there, a mate of mine applied for a higher postion where he is but only gave basic info on application form thinking well boss knows me ect, but the forms were checked and sorted by a HR person at another depot, they did,nt know him and binned the application as little info was on it…
i think its a crap way cos you cant sell yourself in an interview if you already know the interviewer,

It is discrimination but would you want to work for someone/somewhere like that anyway? Probably a lucky escape.
