Is this correct AND legal?

Have been advised by TM that when I stop to tip or load, after 5 or 10 mins of ‘other work’ put tacho onto rest, no matter what I’m doing.
Was told it will stop me running out of hours & allow me to get home.
Is it OK & legal to do it?

A big no no
as there is no longer a split rest you have nothing to gain except you may not need to stop for a 30 or 45 min break on you journey back to base
if your payed by the hour i wouldnt do it (it is against the law anyway)

If you are working, your mode switch should not be set to rest.

Simple answer; DON’T DO IT!!!

On a ‘good day’ the man from VOSA will view it as incorrect use of mode switch (max fine £ 5000).

On a ‘bad day’ the man from VOSA will view it as a false record, maximum fine £ 5000 and up to 2 years in a room with a rotten view out of the window due to the bars across it. :open_mouth:

Your TM faces a charge of Permitting or Causing the offence by requiring you to do it

Cheers for the advice folks. I thought it didn’t feel right & I will not be going down that path.
