but, one of the companies I work for now and then, have a vehicle remotely based and running days and nights, the regular drivers are stopping off at another remote location once a week, in the middle of their shift, taking their digi card out of the vehicle, and downloading it to an optac reader which goes back to the company weekly to be downloaded to their records.
Is it legal to take your card out mid shift or not ■■?

I would say ok to do that providing there is not a gap in the record for that day so a manual entry would be needed for the time it is out of the slot

Cannot see an issue with it. Once you stick the card back in you can just do a manual entry covering what you did

Unauthorised withdrawal of a driver card or chart whilst in charge of the same vehicle is an offence and carries a possible fixed penalty of £120, but who exactly can authorise the withdrawal of the card/chart isn’t clear.
In the case you’re talking about it’s clear that the drivers have authority to withdraw their cards, so I don’t see a problem as long as they do manual entries to cover the missing time.

Why would you send the file to the agency, it’s the transport operator that has a legal obligation to download the data from your driver card, and you as the driver have a legal obligation to make the card available for the transport operator to download
No is the answer.
We do it regular. As long as you do a manual entry showing other work for the time your card is out of the head unit.

I send it to the agency so that they can keep a record as my employer, and so that they can forward it to whichever transport company i have worked for, ( there isn’t always the facility to download at the end of a shift.)
