I would imagine that is down to the contract of employment if there is nothing illegal being asked for

Hi Rog
no hours on contract at all i think its just Monday to Friday working
personally i think it would be your choice but just wondered if you could get done for not doing the 15 hour duty days

Safety would likely be the only reasonable defense if nothing in a contract or agreed verbally
I think there was a discussion on this subject quite recently in the PDF
15 HOURS A DAY!!!
I would tell them to stick it, that only gives you 9 hours to grab some tea, have a was and get some sleep.
If its 15 hours every day every week, once in a while isn’t too bad.
BTW if your minimum hours are not in your contract theres naff all they can do.
My min is 37.5 hours per week.
Mike
I would say not.
If you’re not contracted to hours, other than the very vague “Mon-Fri” then other than blackmail, threat or coercion.
I view the timings of break/rest and driving to be maximum and minimum limits, rather than targets or requirements.
I do remember reading somewhere some years ago about drivers “owing to an employer the duty of making the best of the available hours under the legislation” (I wish I could find it again because it sometimes makes a useful argument to earn overtime)
It would depend if your work for that day required you to use your max of 15hours. Diff story if your job for that day was 1-13hrs and they were being ■■■■■ and telling you to hold it out to 15hrs.

I personally know guys who have been disciplined for this, ‘failing to carry out a reasonable request’. I’m afraid the only sure way anyone will resolve this question when it comes there way is at an industrial tribunal.
Bet you would work the 15 if it meant you getting home though !!
Our contract is for 48hrs BUT we get paid same salary if we do 20 hrs or 60 hrs in a week!!!
so cant really complain if you get a couple of 15hr days- just not next to each other!!
They love to tell you to reduce your rest so as to get you back working next day, i always say "i need my full rest, 11 hours is a minimum - not a target, and you cant reduce my rest- its my decision as you dont know how tired/suitable i am to drive! "
Never been disciplined for taking proper rest!!
If your hours aren’t specified in your contract and what they’re asking you to do is safe and legal then personally I would say that you should get on and do it. If you don’t want to I’m sure there are plenty of unemployed lorryists out there who would happily do the job instead.
