Is it drive time or shift time?

Been doing bread runs this week as some will remember, I only drove for about 4-5 hours max each day. Would I be able to work a full 5 day week next week? I can’t remember if it drive time or work time that counts to that EU rules.

What was the hours of other work ?

Its both. Daily drive time is 9 hours 4x per week, 10 2x per week, and max 90 hours per rolling fortnight. Shift times are 13 hours 3x per week, 15 hours 3x per week, dependant on how you take your daily rests.

6 to 8 hours a day.

Surely you should really keep a personal log / track of driving hrs and other working hrs to ensure that you are complying to WTD and EU driving regs

I get a print out everyday from the tacho machine. The last week I did about 12 hours total driving. My total shift time last week was 60 hours. I’ve opted out of the less than 48 thing.

You CANT opt out of the 48 hour average week. You can only opt out of the nightime working limits if you have a workforce agreement.
Does your 60 hours include your break times? You said you were only doing 8-9 hours a day so should be nowhere near a 60 hour week.

Having read my time sheet ( had to dig it out). It runs like this

9
9
12.5
7.5
11.5
14

This is without counting break times.

63.5 hours then. Did you use POA for any of it? If not, what you have done is illegal - you can only do 60 per week. Just keep your average below 48 - on agency that won’t be too hard. Make sure you keep an eye on it as the agency wont and if youre in and out of different clients they wont either.

Lets just hope you can achieve the 45 weekly rest that is required

The first 3 days i was using POA as someone was driving.

Shift times are 13 hours 3x per week, 15 hours 3x per week

Between weekly rest periods, not per week.

so that’s work and drive for a week
Now split the driving and work that will give you 2 figures a drive and a work
Then work out what you can do next week …

15 hours or so driving and around 34 hours this week for “other work”. I ■■■■ at maths

now work out what you can legaly do next week in driving and work and you have your answer

Well, since I’ve done 15 hours of driving this week I can do my full 56 next week if I so wish however I’ve done 34 hours of “other work” this week. I’m limited to 60 hours max for working time but I need to average 48 over a 17 week period. So I reckon I can do about 40 max hours next week. Please tell me if I got this wrong.
