Interesting read I suppose

Asked this also in Ask The Experts section.

Asking for a friend. If he reduces his weekly rest down to 24hrs am I correct in telling him he has to repay this reduction by the end of the 3rd week? Also is it his decision when to repay the rest or can his company tell him when to?,

Must have a normal weekly rest in the second week and any repaying needs to have been done by the 3rd week

And also in one hit, or en-bloc. So 21 hours added to either a daily or weekly rest. In theory a 45hr rest in week three could count as a 24hr minimum reduced weekly rest, plus 21hr compensating from week one, but then that compensation would need clearing by the end of the third week following that and so on.

Great answers, thanks. Question still remains can work say when to take the extended rest or is it up to driver?

That’s more to do with your contract of employment.
A driver can and should refuse to drive if tired, that’s a safety issue. But choosing.(legal and safe) wurk patterns is down to your boss and what you’ve signed up to.

Franglaise that was my initial thought about playing the “tiredness” card. My friend already knew this though and we were looking to see if anywhere in the regs it stated who takes overall responsibility for when the reduction is paid back. My friend wanted to do it this weekend, and would have completed it by 1000hrs Monday morning, however his boss told him if he did not start at 0400hrs on Monday he would loose a day’s pay as they could not jave his truck stood!

Wouldn’t have anything to do with a certain football match on Sunday evening by any chance?

Grumpy - nope he hates football, just wanted to see where he stood on loosing a days pay

OK, I believe you, honest I do.

Grumpy whether you believe me or not is irrelevant, they may be 20 odd million watching the match that leaves nearly 50 million not - just saying LOL
