As far as I’m aware the DVSA will usually check back 28 days at the roadside.
this is what i dont get with the dcpc - its really not fair on new drivers the amount they have to attempt to understand when they 1st start driving.
and as rog and tachograph have both done is explain it simply, why dont the dcpc trainers do it this way?
something is drastically wrong ( and i still get the odd thing wrong like poa extending the 6hours wtr etc), but the number of posts which are all of the same ilk on this site is worrying.

Its down to a lack of common sense by the EU because there is nothing to stop them making initial dcpc mod 2 a test on the regs
If a driver got caught today at the roadside for insufficient daily rest yesterday then its a FPN and a park up for 11 hours but if they got caught at any time after that within 6 months then its a court case if the DVSA choose to proceed

Are you saying that they go back 6 months at roadside checks ?
The only way you’re likely to get penalised after 28 days is if the DVSA do a thorough check on the companies books.

If they down load a digi at the roadside do they only take notice of the last 28 days? - The down load would show data for many months and the system would show up anything wrong so what would they do - ignore it?
Ooh look, three months ago this driver never had a regular weekly rest for 6 weeks - never mind its over 4 weeks so we will ignore it for now and go to his depot to get exactly the same info… I think not

So when the DVSA say they only check back 28 days you’re saying they’re lying then ?
If they have a policy where at the roadside they can only consider checking back 28 days then fine but the reality is certainly different and I cannot see how they would ignore something over 28 days such as I described
Maybe they do see it at the roadside and policy dictates they go to the operator to officially get the info but if that is the case then its still the roadside check that picked it up in the first place

I haven’t said they can only check back 28 days, but unless they find a history of perpetual none compliance you will not be penalised for anything other than the most serious offences after 28 days.
But again if you have evidence to the contrary please post it.

You actually believe that the DVSA have the manpower to do company audits every time they find a misdemeanour or two
The reality is that for anything other than the most serious offences, or an obvious history of perpetual offending you are unlikely to be penalised if the offence is older than 28 days, well 29 if you count the current day I suppose.
