Hi guys need a bit off advice on infringements. Can you get a verbal warning or written waning for getting an infringement.

If you’re getting them often enough, yes. Keep getting them when warned and you can get the sack. Infringements can harm an operators O license and result in them either having the number of vehicles they can run reduced or it being removed altogether in addition to fines that have to be paid.
You may think that going over a few minutes over your 4.5hrs or being a few minutes under a 45 minute break or daily rest is trivial but a traffic commissioner doesn’t if it happens often and by often even once a week can be more than too much. Since I came back to driving 2 years ago I’ve not had a single tacho infringement for drivers hours and only a couple of WTD ones for going a couple of minutes over 6hrs. If you’re getting them every week or even every month then you need to get your act together. You can start by not trying to eek every last minute out of 4.5hrs/9hrs/10hrs driving before taking breaks, treating the 15 minute warning as a “you need to park up now” and by taking 16/31/46 minute breaks instead of 15/30/45 minute breaks and by taking an extra couple of minutes over 9/11hrs for your daily rest.

An infringement? No.
Infringements, persistent and often? Yes absolutely.
Depend who you work for, and yes the can throw stones at you as well
My company has just been brought out by DFDS and they are stamping down hard on minor infringements such as WTD. I did transport manager for 2 years and never did I give a written warning just took the monthly bouns off them.

Didn’t you know it can impact an operators license? Some transport manager you were.
Yes I did know if they are major infringements they can throw the book at you. I never had a major infringement when I was transport manager only minor ones.

Conor, you’re blatantly and obviously far to superior to be just a mere truck driver …

Your obviously repeatedly getting infringements. The employer has a ‘duty of care’ to you and is ‘obligated’ to training you in order to help you to rectify your mistakes. May I suggest you request further training from them, depending on your age determine how much training is deemed ‘reasonable’.
I hope this helps you, good luck!

It’s not me that keeps getting them it’s other people and I didn’t think you could get warnings for getting them

got a nice house and car then
Your Transport Manager has to ensure that you comply with the Driver’s Hours & RTD Regulations. It is one of the conditions of your Company’s O License, along with maintaining tackle properly & preventing overloading etc.
In the first instance the Traffic Commissioner might consider that just having the infringement brought to your attention with a do not do this again instruction to be appropriate. There is no point in getting your diary out to dispute what you recorded on your tacho, it’s just what your gaffer has to do to keep the TC happy. Don’t refuse to sign it, because any real TM will have no option but to go down the disciplinary route if you fail to acknowledge the infringement.
Repeated instances definitely should result in disciplinary action, up to and including dismissal. The TC wants to see that Operators are actively managing their license and are taking action to remain compliant with the conditions it is granted under. Operators/TMs who ignore “minor” infringements or merely keep churning out letters for you to sign week after week, while taking no actual steps to stop the infringements are plainly not behaving in an acceptable manner.
You need to address infringements and stop getting them. Depends what they are if it’s “harsh braking” you might get a few, but I can’t think of any others you shouldn’t be able to avoid.
I once worked for a firm that had “VOSA in”
I was one of the drivers they looked at.
They found 75 minor infringements, during the period of time they looked at.
The company was told…i needed more training.i never got any…mind lol
We have an ex VOSA person running our complience section. He came down hard on things like moving the trucks about with no cards in, WTD infrigments, H&S and other things. On the plus side, he’s zb hot on getting stuff fixed. If you defect something he’ll have it either sorted out or booked in for it to be looked at before the day is done.
