Infringements - how do they affect hauliers?

I have never used a digital tachograph only analogue ones as last driving job was then tacho exempt (road sweepers).

I hear a lot of people commenting on employers moaning about infringements, when drivers download their cards. Purely out of curiosity can the firms themselves get done for these infringements should DVSA make a visit to them? We all know how easy it is to go over hours when trapped in traffic jams etc.

I did get a digi card this summer when I did my drivers cpc, but it remains unused wherever I have put it.

If a firms drivers get excessive infringements then the company could have their operators licence revoked,especially if the firm are found to be encouraging/pressurising their drivers into running over on a frequent basis.
No operators licence=no trucks on the road.

As an O-licence holder, they are required to “manage” such infringements - whether that be by simply pointing them out to drivers who occasionally transgress, by more structured disciplinary sanctions for repeat offenders or by reviewing their own work scheduling. Failing to do this could result in their O-licence being curtailed or even pulled altogether.

2. A transport undertaking shall organise the work of drivers referred to in paragraph 1 in such a way that the drivers are able to comply with Regulation (EEC) No 3821/85 and Chapter II of this Regulation. The transport undertaking shall properly instruct the driver and shall make regular checks to ensure that Regulation (EEC) No 3821/85 and Chapter II of this Regulation are complied with.
3. A transport undertaking shall be liable for infringements committed by drivers of the undertaking, even if the infringement was committed on the territory of another Member State or a third country.
Without prejudice to the right of Member States to hold transport undertakings fully liable, Member States may make this liability conditional on the undertaking’s infringement of paragraphs 1 and 2. Member States may consider any evidence that the transport undertaking cannot reasonably be held responsible for the infringement committed.

A couple of drivers I know who do night runs to docks, regularly get minor infringements because virtually every lay-by en route is full of other trucks parked up for the night, which isn’t a problem on day runs.

I hate to be the bearer of bad news here,but if you are checked by vosa ,even in an analogue motor,even if you have never used your digi card - if you do not have it with you,they will fine you on the spot. It used to be £60,but as the rest of spot fines have gone up,it will probably have gone up to £100.
