Infringement chaos

I recently started driving 7.5 tonners for an agency. They offered me some night trunking work with a home delivery company, this would typically consist of driving one truck from the depot to one about 140 miles away or so, then bringing another back. I did this for a few weeks and decided it was OK, then one morning I left my digicard in the tacho at about 6.30 am. When I went back for my next shift it was still in there so I withdrew and reinserted it and did my shift. A few days later I had my card downloaded and was told I had infringements, I explained that although they were recorded as infringements they had not actually been committed, obviously I would not have worked solid for around 32 hours as the record showed. Then, another few days later, I did the same thing again but realised while still at home shortly before my shift start. I called the transport controller, he called back to say he’d retrieved my card, I said I was worried about going out as it would incur more infringements, he told me to take a printout and put on the back what had happened. I did this but have now been excluded from working at this company anymore as I have too many infringements! Doesn’t seem right to me but I’m struggling to solve it. The agency won’t give me the name of anyone there to appeal to. Anyone got any ideas?

Always remember your digicard. You wouldn’t leave your wallet in the cab would you :smiley:

sorry to say thats down to your own negligence it is your responsibility regardless you should be on top of something as simple as remember your digicard especially second time regardless of writing whats happened vosa have seen it all before people claiming to of forgotten card not saying you have but rules are rules should be more careful no disrespect sounds like your one of the ones to learn the hard way.

You don’t need telling how stupid you are, or need punishing for it.

This is not something they can just avoid or send you back to the agency for, they should be teaching them the basics. What make the lorry is, what colour, checking tachograph charts and issuing advice to drivers.

You must know who you drove for, give the company a ring and see if they have any jobs.

I fully accept that it is my own fault that this happened as I did leave the card in the tacho on the 2 occasions. The point I am trying to make is that the infringments, exceeding driving hours, insufficient daily rest and exceeding permitted working hours, did not actually happen, they are only recorded on my card due to my mistake of leaving the card in the tacho. I have printouts of both incidents to support this. It was a large company, they would have records to show that I only worked and was paid for 2 normal shifts and not for the 14hours or so in between.

They may not have actually happened in your eyes but because you left your card in the machine the only records they have are what was downloaded from your card and they probably don’t want to change their own procedures for set things.

I too have made such mistakes in the past with my digi card and I now have my own little procedures when finishing the job, including keeping my wallet to hand to get my card out!

Yes, you can go in and ask to speak to the transport manager, ask if you can carry on working for them alternatively chalk it up to experience and try for other work.

A tip.

When you park your car in the yard (assuming you drive there of course!) tie something around the steering wheel, or leave something on the passenger seat to remind you…

A piece of paper that says ‘digi card’ would seem appropriate. :laughing:

Seems a harsh phone them up phone the agency not left digi in myself yet! but have forgot to take it off break once or twice don’t think they would do you for it anyways would they?

Reading this reminded me i’d left my card in tonight :open_mouth: , luckly it was only for an hour but means ive used up a reducer now by about 5mins lol, oh well ■■■■ happens.
