Im Confused!!

When it says you can only work an average of 48hrs a week & no more then 60hrs in any one week & your working hours must average out to 48hrs over the reference period. If like me you dont have any p.o.a & u just take your breaks out of the working time & it still works out that your working over the 48hrs every week without fail then how would i stand. Is this wrong or is there nothing wrong with it■■?
Even if i deduct my breaks im still working over 48hrs every week so after the reference period its not going to average out to 48hrs!!

The answer is simple, you need to reduce the amount of work you do.

As you have said; you cannot work more than 60 hours in any one week. You cannot work for more than 48 hours on average during each week in a reference period.

Are you sure that you are only counting work and driving and not shift time? Your employer should be monitoring this situation and helping you reduce your working time average.

Remember, you cannot ‘reduce’ working time by taking sick leave or your usual annual leave.

All this assumes that you drive under the EU drivers hours rules. If you don’t and only drive under UK Domestic rules then you are not effected by the RT(WT) Regulations.

As i dont have any poa. The only time taken into account is my breaks. All other time while at work is driving & other work while loading & unloading & im normally supervising all loading & unloading so its classed as other work.

How do i know if i work under both sets of regulations or not■■?

I drive class 1 on a regular run dropping of plumbing supplies & collecting goods & moving goods from depot to depot.

Sorry, there is no other answer. Your employer should be monitoring the situation and reducing your working hours, otherwise they commit offences by letting you exceed the stated limits.
