I never knew this one?

In my company the transport manager analyses all of the tachos on this little machine which then prints out any infringements for us to sign and keep. I had a letter today with this error :-
WTD - Excess daily work due to night time working
Basically I either start at 6,5 or 4 am(the 4 o’clock is quite rare!!) but one day after staying out for the night I decided to leave the services early because I wanted to get home early, so I left at 03.36, this letter is telling me I can’t start before 4 because I’m a day shift worker?? :question: :confused: :open_mouth:
Have any of you come across this? I didn’t know until today? :unamused: :wink:

I think if you start before 4am then you’re classed as night shift and can only work 10 hours max

I’ll second that - the before 4am start became an issue in my old job and I argued this over and over again, the boss never listened though. I’m almost certain about the “night worker” thing; start before 4 and you can only do 10 hours of work (any work) I’m not sure if a tacho break is included in this 10hrs though or p.o.a.

Ahh right!!! so I can start before 4, but I can’t work over 10 hours?? because it does say that I worked 11 hours 47 mins on that day!
I just want to be clear then, it’s not saying my infringement is for working before 4 but because I started before4 and went over 10 hours??

Don’t forget you can have a collective workforce opt out from the night worker rule. :wink:

How many hours did you work (driving + other work only) on the day when you started before 4am ?

The company may have a policy to that effect for their day drivers but it is not illegal to do so

Its not illegal but unless you have a workforce agreement in place you are restricted to the 10 hour rule, that doesn’t include rest & POA by the way.

So whenever you start before 4am and therefore, can only do a 10 hr max, don’t forget to make a note of the days this happens and then at the end of the month, when you don’t have enough money to pay the bills, send a short letter the the people who police the WTD and they will send you any shortfall.Alternatively, tell them to shove it. Nobody else in the UK gives a toss about the WTD and if people want to work and earn a decent crust, why the hell do we let some foreigner (and remember, they can’t even make decent cheese abroad let alone run the world) dictate to us.
I don’t know of any other industry that knows, cares or complies with the WTD.

Why don’t we just do the same as other countries do, if a rule inconveniences them, it doesn’t apply to them.
