Hours question ??

I’m off to Majorca with a load tomorrow for delivery next week on wednesday but I need to pick your brains about driving hours.

I’ve been off for 6 days, if I leave tom morning and drive for 4 - 9 hour shifts then have a 24 hour break (sun) how many shifts can I drive for after that and what would my next break have to be (24 - 45) ■■?

you can do another 6 once you have taken a 24 hr rest then you need a 45 hr break after the nxt 6 driving periods, then on the 3 rd weeks rest period you have to pay back the reduced rest you have taken in the 1 st week ,hope you can follow that,daz

Max 6 shifts followed by a 45 - but that still leaves the 21 hours shortfall from the previous 24 reduced weekly to be paid back.- I THINK - I’m not the expert on this - tachograph or coffeeholic are your best hope for a definitve answer :slight_smile:

He doesn’t have to pay it back until the end of the 4th week, he could of course pay it back sooner but before the end of week 4 is the legal requirement. He doesn’t necessarily have to have a 45-hour weekly rest after his next 6x24 hour periods.

Couple of points. If you start tomorrow, Friday, and do 4 x 9 hour shifts that will take you past Sunday.

Suppose you do take a 24 hour rest starting Sunday and ending Monday That rest period can be counted for next week - Week 2, as you have already had a rest period in this week - Week 1 - by not starting work until Friday. This could work to your advantage if you are keen to get home quicker because you could drive 6 shifts and then take another reduced weekly rest. Then do more shifts to get home and commence a full weekly rest period before the end of the following week - Week 3.

For example

Week 1 resume work after full weekly rest period

24/10 Drive

25/10 Drive

26/10 Drive

26/10 - 27/10 reduced weekly rest period 24 hours This period is the weekly rest required for Week 2 and will require compensation before end of Week 4

27/10 Drive

28/10 Drive

29/10 Drive

30/10 Drive

31/10 Drive

01/11 Drive

01/11 - 02/11 Rest period of 24 hours to prevent working more than 6x24 hour periods without a weekly rest. This rest will not require compensation as it isn’t the required weekly rest for this week.

Commence full weekly rest period, minimum 45 hours. If this rest period is 45 hours plus the amount of reduction in the rest taken 26 -27/10 then you will have met the compensation requirements but you have until the end of Week 4 to make this compensation if it is more convenient.

The above will be legal as you will have taken a Regular Weekly Rest in Week 1, a Reduced Weekly Rest in Week 2 and a Regular Weekly Rest in Week 3. This complies with the requirements of the regulations that in any two consecutive weeks you must have either two Regular or one Regular and one Reduced Weekly Rest Periods. Note there is nothing in the regulations preventing you taking two consecutive Reduced Weekly Rest Periods, to prevent working more than 6x24 hour periods without a rest, as long as the requirements for rest periods in consecutive weeks are met.
