A driver is at a place tipping for 9 to 10 hrs with his tachograph showing rest, unlikely to get back to base in 15hrs total day. He is off the following day starting his holidays, could that period of rest be used as a Daily Rest and then crack on home and job done?
legally I would say no but its happened no doubt.
have a nice holiday!
Yes it’s legal. I have done it (once) loading a house in Rickmansworth. I was hardly going to stay there for 9 hours when they finished loading me at 2 am
Had a feeling it was, my mate said you couldn’t.
Breaks a break. if your sat on your arse doing nothing for 9hours and had sleep etc nipped to the shop and all that then why not…
not sure they would say sitting for 9 hours in a canteen is legal it depends on the circumstances.
Did it on boxes. One tip on a Fri afternoon in Scunny at an importer was really long and would push me out of hours after coming up from Grain.
Used to tell them I was heading off on rest and wasn’t available for paperwork collecting and would be doing my own thing, drop trailer, pull unit slightly forward and off for 9 then up at 11pm then drive an hour back to yard. Sometimes used to take unit up to sainsburys then come back with dinner. Lads were great, used to stick paperwork through my door handle in a bag.
Bit tricky at an RDC especially if you’re expected to be waiting around for papers.
Different criteria between break and rest. If I was on holiday the next day would I question it? Would I buggery, I’d be gone bang on 9 hours!
If you’ve 9hrs rest showing on your card/head unit no VOSA going to challenge it and go to court when parked on bay etc.
Unless they’ve been spying through the gate and observed a bitta
“other work” going on.
