Hours for the week.... no drive yet

Due to some ■■■ at work I have not driven since the start of the week but still getting paid.

Yesterday did 2 hours other work and paid for 8hr and the same today 3.5 hours other work and paid for 8 - under WTD do I use the 5.5 hours worked or 16 hours that Im getting paid for (agengy) to use for working out the reference period?

Also since I have had no driving hours this week, Can I still work for the next 6 days? and take my weekly rest at the end of this? ie As from Midday Monday onwards… (I will not be working on Easter Sunday either)

You use the time that you worked, not the time you get paid for.

Although you’ve done no driving, you have been working so legally you couldn’t work another 6 days before a weekly rest.

Within six 24 hour periods from the end of the last weekly rest period, a driver will extend a daily rest period into either:

  • A regular weekly rest period of at least 45 hours.
  • Or a reduced weekly rest period of less than 45 hours but at least 24 hours.

If you started work yesterday after a weekly rest period, then that’s when the six 24 hour periods start from.

If your week started on Monday and you’re not working Sunday you could probably make it a reduced weekly rest assuming that you had a full weekly rest last week and you plan on having a full weekly rest the following week, the reduction will need to be paid back though.

You must commence a weekly rest no later than the end of 6x24 hour periods from when you resumed work after your last weekly rest period. From the details you have posted I assume this was some time on Monday. You don’t say what time but from what you have said about commencing your weekly rest I am assuming you resumed work at 12:00 Monday, so you must commence your weekly rest by no later than 12:00 Sunday. That is the latest you must commence it by but it could be earlier depending what you do for the rest of the week.

As you are not working Sunday can you not use this as part, or all of, your rest period? It sounds as though you will be working Saturday and Monday so as long as the period between finishing work Saturday and resuming Monday is at least 24 hours and you had a regular weekly rest last week, minimum 45 hours, then you are sorted.

Here is the spreadsheet of the times work and rest periods… C part is the hours of rest taken , other two is start and end times.

The way things work out at this place means I got to keep on the ball with things :slight_smile: - I have had 41 hours weekly rest ending yesterday morning at 8am, which was reduced by 4 hours, but between day and yesterday this is 22 hours, so could I use the 4 hours that I’ve reduced and add on to this? Same goes for 10/03 as that was reduced to 38 (-7) but using day or yesterday long rest breaks to bring that one in line again? In fact what periods can be used as weekely rest (any more than 45hrs or 24 if reduced?)

You can use the 22 hour daily rest period to compensate for the reduced weekly rests of 38 hours and 41 hours, 11 hours in total is required as compensation so that works out nicely. and you are clear as far as compensation goes, based on the info you have given.

Any period of more than 24 hours but less than 45 hours can be counted as a reduced weekly rest period. Any period of at least 45 hours can be counted as a regular weekly rest period. In any two consecutive weeks you must have either two regular weekly rest periods or one regular and one reduced.

Looking at the information you have given you had a regular weekly rest period last week so a reduced one is legal this week, you can ignore the reduced rest period between 15th and 17th as that is only there to prevent you doing more than 6 shifts without a weekly rest. So, if you work this week up to and including Saturday, take Sunday off and resume work Monday that leaves you clear to work every day up to and including Saturday next week, after which you would require a regular weekly rest of at least 45 hours. Of course depending what time you finish this Saturday and resume on Monday you may get a regular weekly rest period in and only need a reduced next week, for instance if you were finished by 10:00 Saturday and starting 08:00 Monday you would have had 46 hours weekly rest.
