I tried a search but didnt get much joy. I’m assuming that breaks do not count as working time for WTD. Example I do a 12 hour shift on a four on four off pattern. Only about four to seven hours is driving so I have a 30 minute break within the first six hours, and a 45 minute break at an appropriate time later in the shift. Giving me 1hr 15min of break every day. Our banked hours system records this as 12 hours of “duty” and I count the breaks as “duty” for purposes of tracking my banked hours. When working out my hours for WTD I have only been counting 10 hours and 45 minutes of “work” for each 12 hour shift, is this correct? I’m sure it is but I was hoping one of the gurus on here could confirm it for me because I’ve had a different answer from every other person I’ve asked.
you say in you post
four to seven hours is driving
if you drive for 4.5 hours you need 45 min brake,
so if you did 4.5 hours driving before your six hours WTD brake you would have to have a 45 min brake and as long as you don’t do an other 4.5 hours driving in the day you would of satisfied you driver regs brake and your WTD brake in the 45 mins you took
Breaks
7.–(1) No mobile worker shall work for more than six hours without a break.(2) Where a mobile worker’s working time exceeds six hours but does not exceed nine hours,
the worker shall be entitled to a break lasting at least 30 minutes and interrupting that time.(3) Where a mobile worker’s working time exceeds nine hours, the worker shall be entitled to a
break lasting at least 45 minutes and interrupting that period.(4) Each break may be made up of separate periods of not less than 15 minutes each…
(5) An employer shall take all reasonable steps, in keeping with the need to protect the health
and safety of the mobile worker, to ensure that the limits specified above are complied with in the
case of each mobile worker employed by him.
yes brakes do not count as working time for WTD and just in case POA dos not as well
all that you need to count for WTD is other work and driving
Seems to me that you’ve got it sussed tofer, count the full 12 hours for the company’s worked hours but 10 hours and 45 minutes for the WTD, spot on
As you said only working time counts for the WTD 48 hour week and not breaks or POA.
Cool, thanks tachograph.
