holiday ???????????

hello boyz and girlz,hope you are all well, havent been here for a while,and sorry if i have posted this in the wrong place, here goes, i work AT THE MOMENT full time,and have been with same employer for the last two years,and this isnt the first time i have had trouble over holiday :imp: :imp: :imp: ,this is the crack now, ive had six days holiday this year up until last week,when on friday the boss had forgot i booked this week of as holiday,well the four days after the bank holiday,and he done his zb zb!!! got the week of anyway,but been told that i have had all my holiday im due to date,and that as i have taken this week of,i now ow him as he paid me some of my holiday money,that im not owed yet?. and that i have to slow down on my holidaysâ– â– ?. every where else i have worked,after a trial,or something alike,ive have been entiteld to holiday,so i was hopeing some of yous could help me understand where i stand hereâ– â– ? the jobs getting pretty pants now,and am grinning and bearing the goal posts being moved more every week :angry: :angry: :angry: !!! but its getting pretty petty now,any advise or help gratefully accepted. ps sorry about the spelling,thanks :unamused: :unamused: :unamused: ps paid holiday,and how you are given it day and a half a month orâ– â– ?

hi mate i don’t know when your holidays start but as of 1 April this year if you work 5 days a week you are entailed to 5.6 weeks holiday(28 days)and last year it was 24 days holiday this includes b/holidays

You’re entitled to 5.6 weeks paid holiday per year, if you normally work a 5 day week then this equates to 28 days paid holiday per year including bank holidays.

hello, thank you for ur replys, i did look at the link,thankyou, what im not understanding,is how are u given paid holiday? ive had six paid days holiday (not including bank holidays)wich my boss is saying thats all i am entitled to so far this year, and i work full time,5/6 days a week,and have been employed with him for two years now,and have now taken another four days holiday,wich he is saying he doesnt have to pay me for?because i have already taken what im entiteld to so far this year,so that means to me that any time i want to take off now for the next few months would be unpaid,and if you get 28 days paid holiday a year,is what he saying right?? :unamused:

hi mate it seams like you boss is only giving your holidays as you earn them i don’t know how that works but if you look at you contract it may say how they give them to you

I’m not sure how this works either, it may be worthwhile giving your local CAB a call to see if they can give clearer information on your rights.

I may be able to throw some light on this -

I am going to ASSUME that the annual leave entilement runs the same as the tax year (April to April)

The entitlement is 5.6 weeks per year which is 28 days (Approx)

Divide that by 12 and that is 2.3 days per month (Approx)

Lets say that you want a week off early June and have had all the bank holidays off since the start of April and Easter was in April. (2 Easter & 2 May)
That would be 4 days taken so far and the accrued amount from April to the start of June is 4.6 days (April & May)
That leaves you with an accrued entitlement of 0.6 - not enough for a 5 day (one week) paid holiday in early June.

Some employers will allow Holidays to be taken in advance of accrued entitlement so it spreads the annual leaves better throughout the year but many do not as they may have a problem if staff leave having taken more than entitled to.
