Holiday pay (yet again)

My lot paid me…

Last year but, insisted on paying it over a two week period.

Is that correct or do they have to pay it all in one go if I ask them to.

For example, if I’ve accrued 18 days holiday pay, and I’m taking 18 days holiday, they are obliged to pay me 18 days worth in one go and not split it into 9 days one week and 9 days the following week?

I know they may be excepetions if I’ve agreed to it in my contract with them.

If you’re paid weekly they only had to pay you 5 days each of the first two weeks and the last three days on the last week. In short you get paid as you normally would. I don’t know of anywhere where they’ll give you it all in one go up front.

The second question is why would you want to? You’ll end up almost £40 worse off due to the employees NI you’ll have to pay on wages which would otherwise have been free of NI.

In answer to your second question. I had no idea that I’d lose out by getting it one lump, therefore, I’ll take it as five days each week.

I have always received holiday pay on the day i collect my wages, i think thats the right way to do it whether its weekly or monthly pay…i want it before i go, and not when i`m on holiday.

Conor I never had a job in all my working life (50 years) where holiday pay was split over the holiday weeks,always paid in full before I broke up.
As for being £40 out of pocket,personally can`t see how that happens you pay NI & Tax irrespective if its paid prior to or each week of your holiday

I haven’t had a full time job that did weekly pay for over 20yrs .
Different on agency work I know.
As others have said you can end up worse off due to NI deductions if paid in one lump .
Holiday pay inlue of time off usually ends up with you losing out with higher tax and ins deductions.

If you’re weekly paid at an agency, they’ll pay you the lot in one hit if you ask them - but they’d also advise you against doing thus, as you’d end up paying more tax than if you spread it over the 2-3 weeks you intended taking holiday or at least getting paid that pot otherwise.

The only alterior motive I can think of should an agency say “No, you can’t have it all at once” would be if they’ve not actually calculated what you’ve got to come yet.
This is actually bad news - as it likely means you’re on some kind of fancy-made-up holiday pay rate that is the average of your hours over the prior 13 weeks, or something similar.

Think:

If you worked flat out for 13 weeks, then took 3 weeks holiday, and only THEN they give you your holiday thus calculated, it would include 3 weeks of nowt, and bring that average right down, so your final holiday payment would be reduced by around a quarter. Not good! :open_mouth:

Go with those agencies that make a payment into a pot for accrued days worked, and once that money is in that pot - it’s yours gross, available on demand, and subject to taxes at the prevailing rates when you finally ask to take it.
