Been working last 7 months for an agency,i only work for 1 company on £9 per hour for all hours worked 3 weeks ago i had a weeks holiday,when i got paid only got £6.40 per hour for 8 hours per day.Today when i asked them about it they say they average basic weekly wage so even if you are not at work they still use the days to bring down holiday pay.Has anyone else come across this and how do i find out if it’s legal.
The agency im with calculates ure average pay for the previous 3 months, then pays that. But if u have been at the same place on £9 p/hour i can’t see how they can pay u so little. Which agency is it ure with out if curiosity??

Similar thing at Tescos, I went there for an interview when they were recruiting (Avonmouth) and the pay overall was ok with all the add ons but if you have annual leave you only get basic pay which was pretty poor to say the least so didn’t bother.

That’s illegal, if they don’t pay an enhanced rate, then that becomes part of your holiday pay calculation, check out the rules for ‘casual workers’ it’s all in there and you can print it and show them.
Also, they can’t use days that you didn’t work to alter the figures either, because you didn’t work them, if they want to do that, then you should demand at least NMW for those days, see their faces then.
