Please does anyone have any decent info on this holiday pay/overtime thing that can be claimed for?
Everyone is talking about it depots up and down the land, getting forms from unite etc. But I don’t have a clue if am due anything. I got made redundant 3 months ago from a multi national, is it just current employer or can you go back to previous employers?
as I understand this it’s still going through the court’s although in principal it has been settled, would imagine your union if you’re in one will let you know and ime sure it will be on here most of us are in the same boat
Is this the one where company’s have only been paying the basic 8-10 hours a day holiday pay when actually they’re supposed to average out the hours you have worked over a 10 week period and pay you that or something along those lines?

I’m going to pursue ESL for 4 and a half years I was there! I heard that the companies are trying to restrict employees claims as the court ruling said back to 1998! Try Citizens Advice Bureau or ACAS for advice! That’s what I’m gonna do! HTH

That is only for people who are on varying hours and doesn’t include truck drivers who get a fixed 40hrs with variable overtime as overtime does not have to be included in holiday pay.
I would imagine that as usual it’ll be the agencies who’ve been in breach of this the most.
If it does go through it’ll only be 6 years as Statute of Limitations applies.

I think your mistaken there Conor, I’ve been instructed by Unite I can go back to 1998 and I’m on a contract, seems companies should have averaged out my last 12 weeks work to calculate my hi day pay
