Quite frankly, I’m amazed that this “self employed” status as been allowed to go on as long as it has.
I seems to me that it was a concept borrowed from the construction industry trades.
Watch this space.

We have a guy at our place who is self-employed, he invoices the company every week.

Not legally.

I’ve been saying it for ages that it isn’t proper self employed. There’s going to be some eye watering tax bills landing on the doorstep of a lot of drivers.

No really it depends on how the driver is set up and what else they do with in the business for other income. So conor its not as black and white.

It’s looks pretty black in white to me mate.
If you don’t lease your truck, look after the maintenance have your own operating licence you aint self employed.

Aw the joys can’t wait to see who has the biggest tax bill next April out all the limpers not paying there fair share of contributions haha

Avoiding tax and national insurance for an extra 50p or £1 on hour.
Some of those bills would bring tears to my eyes.
Especially the limpers that say there on a grand a week.
Imagine 3 or 4 years for that tax bill.

Really I’ve never limped as I said there are other factors that come in to play some of the big parcel companies could be upset next year as could may courier companies including one in particular or as usual they’ll find a new loop hole and exploit that

What loophole.

If tax man sends you a bill.
Says your paying as you can’t prove you have leased a truck and had operating licence for past 5 years as your not a O/D.

Then I dare so you will be footing the bill or remortgage the house

This is potentially a disaster for the big companies. The job I do is all agency and has been since it started. If they relied on us before then how can they operate when a pool of drivers disappear before the rates aren’t high enough on PAYE? I know of some agencies paying less then double figures for S/E now so how do they fill those slots if PAYE is under £9 per hour? I certainly wouldn’t work for that and there is no point in going full time for a few months. It would be a waste of time in taking a job when I am starting college in september plus doing volunteer work before then. I need the flexibility that full time may not offer.

The HMRC are chasing a few drivers but ultimately this is cutting their own nose off to spite their face. I suspect that politicians dont do long term foreseeable problems though. Too busy cutting their noses off to see past them

I dare say there will be a huge influx of Turkish drivers soon that will fill the slots pretty fast.

I don’t see why a driver has to fiddle tax to earn a decent wage.
It’s a sad state of affairs.

I don’t get how you can work for agency on PAYE and do the exact same job for more money and not pay NI and lower tax.

You will only get a “bill” if you haven’t been able to satisfy HMRC that you operate a legitimate business, if you have two or more customers, and you are showing a tax paid track record [VAT + Corparation], you don`t have too much to worry about according to my accountants…

This a shot across the bows of the goodship “dodgy mcdodgy face”, you know the ones…limp, blutooth ear jobby, canteen medals, brags about taking £1k a week but turns up in a battered 52 plate Avensis and panic`s if he loses a day :unamused:

I’m no specialist when it comes to employment status, the way some of guys describe your umbrella pay packets makes my head spin. But I can read, and I think the whole second half of that article is confusing in the extreme.

It’s sets out four points you should be able to satisfy if you are self employed. The trouble is these points are how the earlier referred to franchised tipper O/D get around the only having one client loophole.

We all know that the people HMRC are looking at the guys who have set as “Mikes’s Driver Services” as self employed, and go and work for one haulier exclusively driving their trucks week in week out. As such they can’t satisfy the four points. But if they worked for more than one haulier per tax year in this manner, is that not fair play under the guise of being self employed■■?

Don` forget, Self-Employment and LTD are different animals, with LTD, you are an employee of the company, you are paid via PAYE if you take enough out, or, you are under the threshold and rely on dividends to boost your earnings. HMRC have tried to close the dividend path by changing the tax rates on them.

This is a “flush out” exercise to get those that should never be near a business bank account to panic and chuck the towel in, you have only got to read the antics of this breed on some of the Facebook pages related to “drivers”, they are purely in this to rip the system off and make as much as possible, most seem to be short of a few brain cells :open_mouth:

HMRC would do better chasing the small builder [UK/Polish/Indian], who are without doubt ripping the system off, Ive got mates who cant charge VAT or they lose the job, everything is cash :unamused:

This is precisely why I move around. This time last year I was with a different agency and client. I work for 3 agencies for a few months at a time to satisfy the criteria but if I did this on PAYE I would be hammered with BR tax. I choose where and when I work due to personal circumstances. Being employed would be too much hassle and I couldn’t tolerate anyone long term anyway which is another reason to retain my flexibility. Better to walk away than be thrown out

One: Go and ■■■■ yourself with a big stick.
Two: I know that agency is beneath such a one as you. With the gearstick shoved so far up your jacksie it’s difficult to move to a different company. Agencies don’t really offer you much choice. You either go through an “umbrella company” or don’t get paid.
Three: Point One was for calling us limpers. I joined the agency because no ■■■■■■ would give me a job. Would you offer a 19 year old a job? So I’m so ■■■■■■■ sorry for supporting myself and my rather small family (just me and my missus). So don’t harp on about “not paying contributions” because you drive a nice green truck and bend over every monday to let your planner in. :grimacing:

TBF, there are quite a few who do limp, I hadn’t noticed it, until somebody pointed it out on here

Point TWO ; fair comment about trying something different to get a job, impressive

Jesus.
I know it’s Sunday morning but livin up for [zb] sake.
If you have an attitude like that no wonder you can’t get a job.

Mr green don’t think so.

I would love to have a job that suits my life style and pull a grand a week but unfortunately I woke up and smelt the coffee.

I don’t see how lads can do same job paid more and pay less taxes and NI.

I was agency and on an umbrella scheme. My tax went through and I got a £762 cheque back for over payment.
Its not all a big bad scam if you are with a proper accounting company

Surely all is good, if:

a) You are limited company and vat registered, and the company have multiple clients per tax year.
or
b) You are self-employed, work for multiple transport companies, and complete a self assesment tax form (quarterly I believe) and pay the necessary tax and national insurance contributions as set out by hmrc.

Sometimes its nothing to do with tax but having the flexibility to say no im not doing this that or im am having these days off due to family commitments any how looks lime connor fixed his record I can only deduce that he got burned by an agency or umbrella scheme at some point
