HIAB Licence/Certificate

I am working for an Agency at the moment who put me through a Hiab course as they needed Hiab drivers. They wanted me to sign a contract saying that if I left within a year I would have to pay back the course pro rata, I declined unless they put my clause in which said if they don’t give me enough work then I am free to go looking elsewhere and won’t have to pay anything back. They never replied and when I do hiab work they fax the details to the client, so I do not have a certificate/Licence, they are holding on to it.

Now my question is :

Is it legal for me to drive a hiab truck without having any proof on me when driving like it is if I am doing ADR work?

Have I any right over the licence, does it belong to me?

Any guidance would be grateful, thanks.

I have had mine for 16 months and the only time i used it was when i did the training.

I would see how much the course cost [ask the training people not the agency]

then sign the thing get the certificate off them, then if you were to go else where give them how much you know it costs.

otherwise if the company you work for is pretty good, explain what has gone on and get a copy of the certificate off them.

i would have thought its like my company when they put me through my cscs card and driving licence 's for plant machines…they said in my contract if i left within 1 year of getting card then i will have to pay back a pro rate amount but i got my card straight away as the card is mine just like the cert you got…ask the company if i sign will i get my cert if not why not?also ask what happens if u leave before 1 year

Just for the record, you do not have to have a certificate. I don’t, and it is perfectly legal, it does seem silly with you not being able to prove you are qualified but that is the way the rules are written.
