That was never legal, you just did it and got away with it. Your work as a fitter would always have been classed as other work, especially if it was for the same company. the main difference between now and the “bad old days” is that when stuff like that went on, your example or others like shunting at night (fuse out) and driving during the day card in, is that the earnings for it were a bloody sight better than now in relation to other jobs
OK Eddie, mostly legal, slightly bent…I wasn’t driving ALL night, possibly football run/theatre trip. Mostly never exceeded 15 hour spreadover. Probably didn’t complete weekly rests as we should have, especially in summer season. We were off tacho. for a lot of the time too…school runs/swimming contracts etc. As I said bad old days…it was all a bit of a minefield then & a mix of rules (Domestic/EU/none at all!!), all the RTD/Drivers’ Hours Regs. should at least help these days in that scenario I was in■■?
Funny how the most greyest of ‘grey areas’ always used to involve the most precious cargo of all - children & often they were(still are) transported around in the oldest, less technically advanced vehicles - all down to keeping costs down!!

Then as long as you’ve not reached 4.5 hours driving you can continue although you need obviosly a 4.5 driving break or another 15 mins working time break before or anytime B/4 11.75 hours…
So you can still get 3 breaks of 15 minites or 2 breaks at 15 minutes and 1 of half an hour.

The real question is why can i work on an oil rig,in an operating theatre,a quarry,an old folks home etc as long as I like but can only drive a truck for 90 hours a fortnight.Its hardly [zb] hard work is it? then I can drive my car 2,3,10 hours home and thats not a problem?
Is driving the only part of a drivers work?
RTD is based on the amount of working time done in a fixed week but I would rather see an amendment to the drivers hours rules which would state a certain amount of total REST time required in a fixed week
There are 168 hours in the fixed week - how many of those hours should be recorded as REST to prevent a driver working too many hours ?
There are quite a lot regularly doing 60 and lots do 71 hours and even 83 hours at work.
Deduct 1 hour a day break thats 79 hours max ? Or is it can you do more?

When the WTD directive was first mentioned there was hope that it would lead to a reasonable 48hr working week and that the resulting shortage of drivers would mean a decent wage and no longer having to work hours that even the Victorians would have thought beyond reasonable. Certainly the parcel firm I was working at at the time was looking at quite a significant wage rise in the wage negotiations.
But then the bloody pandering to the RHA and the stupid ■■■■■■■■ drivers too stupid to see the benefits shouting about not being able to earn a living unless they could work 84hrs a week happened with opt-outs and a rewriting of what would be classed as work resulting in the reality that nothing changed other than more paperwork. No shortage of drivers, drivers still needing to do 60+hrs a week to earn the national average wage.
So if you want to know why drivers earn less than a shelf stacker at and have to work a week and a half to earn the national average for a 40hr week you have the RHA and the half-wit gobshytes to thank.
