New to nights and not 100% on the hours I can work. I’m out at the moment started shift at 7:15pm got to drive 4hours tiny delivery which had got to be there at 9am I then need to drive back 4hours when do I have to park up tonight ? Thanks
You can use a 15 hour spread 10:15am
or a 13 hour spread
08:15am!
the choice is yours!
although you’ll be late!

Unless you have an opt out agreement in place, legally if you do any work between 00:00 and 04:00 you can only do 10 hours working time in the period of 24 hours from the start of the shift.
The period of 24 hours for the RT(WT)R 2005 is actually 24 hour duration, it’s not reset when you start another shift like it is in the tachograph regulations.
Your shift started at 19:15 so legally without an opt out agreement in place you can do 10 hours working time between then and 19:15 tomorrow.
Working time does not include POA or breaks.
If there is an opt out agreement in place the number of hours of working time you can do is the same as working days, or whatever the opt out agreement says.
FYI whilst most companies, certainly most large companies anyway, comply with the working time regulations, VOSA at the moment do not actively enforce the RT(WT)R, whether or not that will change any-time soon we have to wait to see.
Ok thanks for your reply I have opt out agreement I remember signing I know I will be finished work about 3:00pm
I will have roughly 7 hours sleep and 1 45 break after my first 4 and a half driving tonight
I’m not entirely sure what you’re asking, but if you started at 19:15 and you’re having a rest period of seven hours during the shift you will need to start a daily rest period no later than 09:45, that’s assuming you have a reduced daily rest period available.
So if your delivery is at 09:00 you won’t be able to drive back unless you can get at-least nine hours consecutive rest before doing the delivery, or at-least before driving back.

I think I read it in the same way as you tachograph, ie, he’s not having a daily rest period.
I’m hoping it’s just a mis-understanding

To be honest that’s what I’m hoping as well.
Actually I made a mistake when I said “that’s assuming you have a reduced daily rest period available”, if you have a seven hour rest period during the shift the nine hours after the shift won’t be a reduced daily rest period, but that doesn’t change the situation at-all I’m afraid.
