then the numpty pulled of on 24 mins so he rang me asking could he just have another 15 and then he is good to go
my understanding was that you couldnt do that as i thought your last break has to be at least 30 mins he wouldnt have that and decided to ring another driver ( presumibly to get the answer he wasnts ) i should point out he had already had a 45 earlier in that day

As has already been said your correct, used to be able to take three 15s but now its changed.

As a DCPC trainer I am still coming across drivers taking 3 x 15m breaks or other variations on the theme and that just won’t accept that what I am telling them is correct.
I’ve even had feedback forms at the end with comments suggesting I have given bad information. It is hard to understand what it is about some of these guys that they just won’t listen. For these types the DCPC is a waste becasue they walk out at the end of the day shaking their heads and going right back to what they believe.

Even though he had been fined and parked up he still believed he could have a regular daily rest having worked a 15 hour duty period. he left the DCPC training session believing that VOSA had it wrong, I had it wrong and most of the drivers on the course were idiots for listening to anyone’s version of the rules but his.

In their defence though, I WAS given bad information during a dCPC course (Mercedes Benz course - Tameside College) and documented the fact on here, even have the bad info in writing as proof, and the instructor wouldn’t listen when he was corrected, even with the correct information shown to him.
I’m not saying you’re a bad instructor, but some aren’t as knowledgeable as they should be.
Now, I was on coaches a long time before I came onto trucks, I was driving coaches when the rules changed and I knew the rules before I went into the dCPC classroom, so for me it was a waste of time and money (sorry guys, was your money that I wasted, gvt funded course).
Also, I take it upon myself to keep upto date on the rules, hence being on forums like this, not saying I’m perfect, but if I’m wrong, I’ll get corrected and learn from it

He is obviously working to the new rules introduced just this month to replace the old MMTM* (2004) Regulations. He is now using the new, and much updated, FMA* (2012) Regulations.
