Help needed please (big time)!

I got a call on the mobile today, my boss say’s to me ,"bring the wagon back
straightaway, don’t make any more collections or deliveries, just come straight
back in :open_mouth: "

My first thought was, somethings happened in the family and they won’t tell
me incase i can’t drive back, so i make a few phone calls and everything’s
o.k.

when i got back to the yard, the word going round was that the firm’s gone
bust :open_mouth: , but because we’re only a small depot, with our work being
brought to us from a hub in the midlands every morning, none of the bigwigs
are there so we can’t find anything out. Everybody’s shook hands with one
another, wished everybody all the best e.t.c. not knowing if we’re in
tomorrow or not.

What i need to know is, because i’m being made redundant in September,
if the firm has gone bust , a,m i still entitled to my redundancy? (somebody
at work said the government pays it, if the firm can’t).

Also we.ve just changed from weekly pay to monthly, so on top of my redundancy, they owe me a months pay, about 30 hours overtime, plus
my holiday entitlement, and i don’t know if i’ll be able to recieve any of it

Oh well at least the sun’s come out!!! :laughing:

Sorry, I’m not “up” on employment law at all and don’t pretend to be.

One thing I will say though is being entitled to redundancy money and actually getting it in your paws are two completely different things :exclamation: .

Try to gather as much information as possible about the situation and get down to your local citizens advice office,are you in a union,yes then phone them up and ask for advice,how long have you been at the firm as this will
be used as to how much if any redunacey is payed out,

As far as I understand the government do have a fund to pay redundency, but your wages might be a different matter. I believe if the company is in the hands of the receivers then you would have to put a claim in against the assests of the company, and the bank get the first call on any funds. You’d have to share whts left with all the other crediters. Go and see CAB or your union.

thanks for the advice so far chaps, it looks like it’s gone kupputt, i,ve just had a
phone call from one of the lads (chargehand) and he says we,re going to get
one weeks pay next week, and we have to ring a number ( i think it’s the
administrator) and apply to them for the other three weeks, not sure about
the redundancy payment though.

then again on tuesday, to take everthing down to the hub in a van,
come back then take the van off hire, so won’t be able to get to c.a.b.
till at least next wednesday.

some of the owner drivers are owed thousands.

It was a firm called A.M.P i,d been there 17 years.

we,ve got to fill a form in on tuesday to apply to the administrators for
the rest of the months pay plus redundancy, then pray :laughing:

Why have you “Got to” do anything for them if they can’t even pay you for work you have already done? Why do anything else at all for them?

Thanks very much for all the kind words people. I had to go in yesterday and
on tuesday, because all the employed personnel have been re-employed
for one week, to sort all this kind of stuff out, and if you don’t then you have
deemed to have sacked yourself thus lose your claim to any remuneration.
so i don’t want to take any chances.

I’ve found some very usefull info from the link that hitch put up, on the D.T.I
website, i,ve got to dig around some more on there, because it appears you
can claim your money from the (probably some government agency) not
sure where but you fill in a form r.p.1 and you can apply for your un-paid earnings, plus redundancy money. I,ve had a letter this morning telling me
that the company has gone into liquidation, so i have to first find out the distinction between administration, and liquidation to see if i can still make
a claim, because all the reading i’ve done so far, assumes administration.

On a lighter note, at least i’m becoming a decent house husband, i’ve got the washing machine sussed out already, just have to psyche mesen up a bit more to start the ironing. Got the ironing board out but then had to lie down to
think about it for awhile :laughing: Been ordered to have it all done before she gets in

I think the basic difference between liquidation and administration is this.

Administration is where the company’s directors decide, the firm is about to go down the pan and call in the ‘administrators’ (accountants) to assess the situation and decide how to resolve the matter, which normally means closing parts of the firm and selling off some assets or look for a buyer for the whole company. (much the same as MG Rover)

Liquidation means the firm has literally gone down the pan, clients, banks etc have pulled the plug on them and have apointed and accountant to close up shop and recoup what ever they can for creditors.

What difference it makes you though i’m not sure

From a past experience, you as an employed driver do not have so much to worry about. The first claim on any money is taken by Inland Revenue followed by any VAT owed, then if there are any fines outstanding they must be paid. Now it is the drivers turn :stuck_out_tongue: There is a fund available for these times when a company is completely destitute. Normally there will be assets that can be seized to cover staff wages. You are still employed by the company until you are given notice, so comments like

This happened to me 2 weeks before xmas.

You will get payed and if you have been there longer than 2 years you will get reduancy payment.

You will also get your holiday pay.You will not get any expenses that are owed.

You really don’t have to do anything as the administrators will send you forms to fill out and then you just send them back.To a place in scotland i think.

The money is payed from a goverment fund.

In the mean time look for another job,i think it took about 2 months for me to get payed out,also the pay they give you is capped at £240 per week.

cheers mate for the info. This is what i found out on the D.T.I website, so
it looks like it’s just a case of surviving till i get my money. I.ve got the first
£50 of my wages insured so i have to claim for that, but you know what
these insurance co.s are like when it comes to paying out :laughing: Then see
what the dole have got to say.(Thinking of going on dole for a short while
to get my college courses free :laughing:

As for getting a new job, i applied for a job (class 2) the other week, now
really i need a company thats got artics as well so i can move up, but this
job was £22,000 a year so you can see the attraction :laughing: it looked a brilliant
job, brand new scania only about 45 hours a week (paid for 50) nice steady
job,but i haven’t heard anything from it. i had my heart set on getting it, but
when i asked how many applicants there had been, they said about 150
for about 4 vacancies. So much for this driver shortage aye :smiling_imp:
