I’ve had licence 14 years bu just started from last June 2013
I I only work 2 --3 days a week
I’ve had my card since June 2013
I’m a bit worried I’ve got some infringments
So I got myself a digifob to check for bad marks on my card
Infringments
17.7.14 6 mins over time stuck in traffic- I have print out
2). 24.5 14 4 mins over time stack in traffic I have print out
Last on 18.8.14.
I put my card in to do manual entry it asked was this end of shift I think I’ve pressed
Wrong butten I think I’ve put other work instead of bed I worked two days before this
It’s showing I’ve been driving for. 16.49 min & 18.11 other work on digifob
When I started working that day break was flashing after1.10 mins driving not sure what I’ve done. I want to do this but I’m very worried looking at the fines on internet
Has anyone on her been stopped by vosa I’ve not been stopped not sure what what’s the drill will they know what I’ve done regarding mode switch.
Do you think or get a fine for this
I’ve done 2 days cpc up to now if I’m looking at huge fines I’m not carrying on.
Hope someone can shed some light on this for me.

If you do have the printout, keep hold of it and highlight the infringement areas with a brief comment stating traffic jam etc. Even the most ■■■■ of vosa employees should take that into account as long as you can show you took a break soon after the time of the infringement.
You’ve got printouts for 2 of them and I’m sure you’ll be okay, The 3rd one sounds like a mistake. Believe or not the VOSA, DVSA, ministry or whatever aren’t a bad bunch mostly if you’re ok with them and do understand we all make mistakes, At least that’s my experience of dealing with them.
I’d get a printout for the 18/08 as well and put something like wrong mode selected.
You need to do printouts for the 18th of August and the last shift prior to that date when you used your driver card.
Write an explanation on them showing the times you finished the one shift and started a new one on the 18th, in other words explain that you screwed up a manual entry and the time the card was withdrawn was a rest period.
These are not serious infringements so chill out.
You do need to be a bit more careful in future though, the important thing is that you don’t make a habit of getting infringements, the occasional minor infringement can and should be excused, but it doesn’t want to become a habit
Do not worry about it,as this will affect your driving.
It is not the end of the world.
If you do get stopped, have a good attitude with them and it will be ok.
Humans make mistakes.
They are only targeting drivers that falsify records on a repeat basis.
Relax and concentrate on the driving.

I take it that’s driving time?
Don’t lose sleep over it bud, it happens and they know that, traffic jams and all that- it happens. Just keep the printouts.

Sounds like it was on other work whilst you were at home on rest so it thinks you’ve worked right through. Most digi tacho’s default to other work when the vehicle stops moving so if you leave your card in over night then that’s what’s probably happened. Most including me take out card after every shift. There are two reasons for this. First is it saves forgetting to put it on rest (when you leave it in) and secondly, its a legal requirement to enter the ‘end country’ after every shift. Its not impossible to do IF you leave card in but its more faffing about pressing buttons. Personally, its easier to take the bloody thing out.

You wont get huge fines. If you pass the attitude test (aka the first 30 seconds of ‘hello driver’), they will tell you to take more care in future and try not to balls it up again. They are looing for the big ■■■■ takers, not for ■■■■■■ the arse of drivers who have made a genuine mistake.

I think you’ll find that you won’t be fined for minor infringements of this nature after 28 days.
I believe the statute of limitations allows for prosecution of these offences for up-to 6 months, but I think that would only ever happen if the DVSA had some reason to take you to court within that 6 month period, and they would generally only take you to court if you’d done something really daft or had an accident caused by none compliance.

I don’t think the OP has enough to worry about to go down that road.
You’re suggestion may be a valid one for anyone who’s got loads of infringements but I wouldn’t go as far as saying it’s legal, offhand I don’t know what the law is against deliberately losing your card to hide infringements but I’m pretty sure there must be one

Mine still shows an over speed event from 2 and a half years ago!

Very true, but if you are a serial cab hopper the chances are you may only drive “the offending” truck a couple of times a month.

Again absolutely correct, but these historic infringements would only come to light during a DVSA visit to the Co. A roadside check of a new card would obviously not show infringements incurred on the old card.
Lets face it, if he is getting regular infringements bad enough to be of concern then he is clearly doing something wrong and needs to change his way of operating as opposed to getting rid of the card. If he is an agency driver then the chance of getting done for an historical event are slight if non existent but this would be different if he drivers the same vehicle.
I would advise he learn the rules and abide by them.
The problem is that VOSA booklet is quite ‘■■■■’, I have been to 2 tachographs CPC courses now and still don’t get it all. I have now started to break info down into small chunks and compiling a list for dummies (like me).
