Help defects vosa and penalties

I’m new to this and I’ve herd two sides to this
Often I find defects on my truck and filled out defect form and waited for it to fixed . I phoned the boss said your out on night run and you have a mirror cracked near side blind spot one. I’ve spoke to other drivers they say just fill out defect form and you have done your bit if you get pulled they will keep the truck there till they fix it, so no penetlys for the driver? I’ve been told that the cpc is a whole thing to put it all on the driver so the employer has no problem.

I’m worried now shall I refuse to drive it or just soldier on I’ve been told I’m on stoney ground so don’t want to loose my job as I’m a newb and worried I won’t get any more work. But at the same time don’t want any penalties.

Shall i refuse it walk into the office like Rambo and make the tm eat my boot lol

Well there is your problem.
Simple. If it needs to be defected, it needs to be fixed, before it goes out. Defecting a problem and taking it out on the road only tells VOSA that you knew about the defect, and took it out anyway.

How badly cracked?

Common sense should prevail. Is it missing, Is it cracked but stil intact or is it shattered into hundreds of pieces?

You say you’ve phoned your boss but haven’t actually said what he’s told you to do.

If its got a crack through the middle of it but you can see perfectly well out of it and its not going to fall out then defect and crack on.

If its cracked into a dozen pieces and you can’t see clearly through it, defect it and don’t take it out til its fixed.

I always carried a couple of spare mirrors (Supplied by the boss) and just changed it myself if one was broken badly enough to make it useless. Usually only needed a screwdriver to change so it’s not a big problem.
(Or just stick it over the broken mirror with Sellotape until you can make it back to the workshop)

dont quote me but as i understand it if it wont pass on the mot then you have a problem also if its fitted to the truck it should work
