The offence will only attract a road-side fixed penalty while the offence is current, but If my memory serves me correctly, under the statute of limitations it could potentially attract a prosecution for up-to 6 months.
However, of course you’re not going to be prosecuted for anything other than perpetual none compliance or if the offence contributed towards an accident.

Pack a bag, try and change your appearance a bit…maybe shave your head or grow a beard, or both.
You must burn all the clothes you were wearing at the time…that is a MUST, to destroy any evidence.
Did anybody witness it? We may be able to sort that also, but it could cost.
Pm me and I will tell you where to leave a grand in USED notes, and I know people who will supply a false passport for you.
If you need a shooter I can arrange it, but we are talking another grand.
Trust me I’m a old hand trucker, I can sort this so don’t worry.

Not yet. Currently a fixed penalty can only be issued for something committed on the same day as detection. DVSA are pushing for penalties to be issued for any offence/s in the last 29 days. Not happened yet though.
Prosecution is only likely for multiple offences as Tachograph has pointed out.
This is why I don’t get it when drivers are panicking about offences. Unless they are continually offending it shouldn’t be a problem.
DVSA do however seem to have a habit of pretending they can fine drivers at the roadside and then claiming they’ll let them off ‘on this occasion’ or even issuing fines when they shouldn’t.

You’ve actually committed two offences. (Not WTD offences but driver’s hours offences).
The first is going over the 15 hour duty day.
The second is not having the required minimum 9 hours rest.
The second offence happened due to the fact that once you worked more than 15 hours - in your case 16.5 hours, only 7.5 hours were left in the 24 hour period which began on your start time - ie 16-30.
Expect infringements to be forthcoming.

There is only a single offence. There is no such offence of going over a 15 hour duty day - the offence is insufficient daily rest BECAUSE of the more than 15 hour duty period.
The OP should expect an infringement from his company, and this is a £200 fixed penalty but only if caught on the day so can’t be given a penalty now. On its own the offence also doesn’t warrant prosecution but if there are other offences of a serious nature i.e. Offences that would have been £100 or more fixed penalty then the OP might want to stand by over the next 3 to 6 months as it could still lead to prosecution. BUT HIGHLY UNLIKELY

There is no such rule of a “15 hour day”.
This is why people get confused, because they hear about it but can’t find it referenced in any official guidance.
There is a requirement to take a daily rest of at least 11 hours within 24 hours of the start of the shift, which may be reduced to 9 hours within 24 of starting three times between weekly rests.
That is what dictates when you must start (and finish) a daily rest.
Hang on, this was 3 days ago. Just carry clean Y fronts for 26 days.
It’s some time ago now, in fact it’s well over 10 years, but I got 2 separate infringements for very similar circumstances.
I worked for 15 hours and 2 minutes one day.
I got one infringement for working more than 15 hours and another for not having 9 hours rest.
It was when working for Securicor Omega Logistics at St Helens (at the Owens Corning place).
How does it work in other EU countries? Do they just work on the current day, the last 28, or as far back as they can get?
