Harry Monk:
From a safety perspective it would make sense to ■■■■■■ vehicles off of the motorway and the Filth always go ballistic if they find somebody stopped on the hard shoulder without good reason on TV programmes. I imagine the reason they do it themselves is because that’s what they are instructed to do, on the grounds of “visible policing”.
The reason they do so is because they have an exemption.
Police cars are exempt from the danger of being hit by another vehicle while on the hard shoulder?

Absolutely, there’s more chance of you crashing into the central reservation barrier once blinded by their fit inducing strobes than actually rear ending them.
robroy:
I personally would refuse to sit in the back of a Police car if pulled for something on the hard shoulder, I’d be at high risk if a truck or even a car ran into the back of it.
Would that be an arrestable offence refusing to comply with their request or what ?
Under the Police Act 1996 s89 it is an offence to resist wilfully obstruct a constable in the execution of his/her duty.
Willful obstruction of a police officer means doing any act which makes it more difficult for the officer to carry out their lawful duty e.g. stopping them doing something, de-arresting someone, deliberately misleading them, or giving a false name and/or address.
^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^
which has nothing to do with robroys post or mine.
unless you are being arrested, then you are not required to leave your vehicle, you are not required to go into the plodmobile, do not need to open the door,or let them access the cab or car.
if its ■■■■■■■ down and they want to stand outside getting wet, then that is their prerogative.
you must as the driver give your name and address, and as for insurance ,mot, ect, they can see all that on their computers anyway.
if you prefer, you only need to give your name and address then take the producer and hand it in later.
you can refuse to sign it as they always try to pressure you into doing so,and you do not need to sign the form when producing.
you do not need to say anything unless you wish to.
if you prefer, you can just repeat.i do not answer questions till they give up and go away…if they prefer, they can arrest you and give you the option to sue their ■■■■ off later…remember to leave your camera on as they do so.
they do not like cameras recording them9 ( for yours and also their safety) and they have no right to tell you to stop.
once arrested they can take your phone, but they have no legal right to look at anything or delete anything on it ( i think without a court order) though they will bluff you about the terrorism pish to try and make you switch it off.
just assume they are slimey lying condescending sleekit scumbags which 99% of them fit the profile and treat them accordingly as any conversation they have with you is for their benefit and not yours.
you only need to see what happens when they get caught with their hands in the till to know how to treat them.
look at poor angus as a perfect example…

Well I hope if your ever in a crash, get burgled, get assaulted, wife gets assaulted, child goes missing…anything at all, I hope you don’t need any help from the police or want them attend to you because your surely don’t deserve it coming out with all that. Police should have a list in the control room for people like you which is basically a list of people they won’t bother with for a 999 call. Oh its him or thinks this of us, sod him then.
all im saying is that you do not need to speak to the cops if you do not wish to despite what they like to imply to the contrary.
theres plenty of cops get caught and done for being liars and acting improperly and they are just as corrupt as any other member of the public.
i quite happily interact with them on a as and when it suits me.
the fact is that you do not need to if you do not wish to though they like to try and browbeat you into doing so by lying to you.
some are no doubt upstanding.
some (mostly traffic plod ) have a similar sense of perspective as a traffic cone.
the ones like that, then i have nothing but contempt for akin to wombles in general.just plebs.

There is no reason for you to get out of your vehicle, unless you are under caution. A request such as “can you step out of the vehicle” can be refused unless there is reasonable grounds and you are under caution, although many people do as they feel intimidated and pressured

So would I, I would say its even more dangerous since they introduced smart motorways, we now have a generation of drivers, some of them think of the hard shoulder as a running lane, even when it’s not lit up as such

Tbh with you mate, given the choice of being fit up by you lot with some trumped up charge, and risking ending up squashed under a 44 tonner that some ■■■■ cannot drive properly, while sitting in the back of your patrol car,…I’d take the former rather than the latter every time.
As said, I’d be extremely polite giving my reasons for my reluctance, if they can not see my point, then arrest me.
So why is it deemed dangerous by Police opinion, for me to sit in my car in a breakdown, but miraculously deemed acceptable when it involves you lot?
its called double standards old bean.
similar to the logic of,do what i say,not do what i do…
they cant arrest you for not leaving your car/truck unless they have a different reason to be arresting you for, same as for telling wombles to ■■■■ off and mind their own business when they want you to leave your nice warm car and walk up the grass verge to stand and freeze till the rac show up.
sit in the truck with the heater on and let them talk to you from outside through the closed window works well enough if it suits you.
showing them you or your passenger is filming them has them changing their tune somewhat.
