My understanding is that the agency should pay a minimum shift. Whether the company is asked to cough up or if the company does cough up isn’t relevant to you.

When ever I’ve been cancelled and I’ve set off, I’ve been paid the full 8. Short notice cancellations ■■■■ and it’s up to the agencies to charge when it occurs but that’s never gonna happen. Ask for a bonus to be added onto your next shift.
Don’t fall for the ‘we haven’t been paid by the client’ spiel. Your contract is with the agency not the client, it is the agency that owes you the money. It’s exactly the same principle as me putting £30 of petrol in my Bentley and then telling the cashier ‘I’ve haven’t been paid so I can’t pay you’.
Arnt you guaranteed 9 hrs , I’ve not done masses of agency work but always have been guaranteed the 9 hrs & have always been paid it
Ex arrive tuff nwk to be told there driver was now working as he’d cancelled his holiday , no sorry mate , just don’t need you , fine with me as paid 9 hrs whatever , so inform agency who seem fine
Get home , phone rings , can you go back to tuff as they’ve a London run now , no been there & not going back again tonight , thought you’d say that with you being paid guaranteed 9 hrs , ok , 15 mins later , agency , tuff will bring lorry to your house , your joking , my house is in a little culdesac so they’d never get here ( waggon & drag ) & no I’ve been there , it’s getting late , ok thought you’d still say no
And contrary to what’s said above I was back there the following night & regularly after
On your point of dumping truck etc , whilst employed I was meant to have a disciplinary with the main boss ( traveling from glous - Grantham ) , apparently to get me to toe the line , I just jacked , didn’t tell them & got the depot boss raving & ranting down phone whilst I couldn’t give a ■■■■ as I’d left
Que 19 yrs later whilst doing a bit of agency they want to send me to said place , explain what went on but still say go
And see what happens , turns up & manager ( not one I had at time but was there at time ) explains everything then says did you leave whilst under a disciplinary , yes explained it all and he just says I thought so , it was —————- who was your manager , fell out with everyone & don’t worry , did 1 st shift & was offered job when I got back , didn’t tKd it but said if you ever want a job & we’ve got one you can have it , so it’s not always a case of burnt your boats

Is it against the law to cancel at very short notice? No.
Do you have any legal right to be paid for a minimum number of hours in this situation? Depends on the terms of your contract with the agency.
As for your options - 1 and 2 are both covered by the Theft Act 1968, for reasons already mentioned by others. So option 3 it is then.

I can then show my boss and explain why I deserve a pay rise as this would be the standard you will be getting when I leave, guaranteed to have him sweating and reaching for his wallet.

I’am so glad I don’t use agency drivers .
It just shows that if you do, it’s not an excuse for poor treatment of the workforce. Property damage and physical violence can be a great leveller.
If you book a man in, you have to be prepared to pay him regardless of the state of your equipment when he gets there, that’s the reasonable settlement between employer and worker.
FFS two hours for your wasted commute and ask them for 60 miles worth of fuel money.
Feel free to take any other option and bite the hand that feeds you in a nightmare job environment to the tune of 472 applicants for one job.
If you book a place on an airplane and your car breaks down on the way to airport so you miss the flight, are they going to refund you the money? Yeah, thought so. Why is it ok then to book a driver and then cancel their shift same day and not pay them? Drivers time worth 0? If you hadn’t been ‘‘booked’’ for this shift you could’ve accepted the other booking which was 8 hours @ ■■ £ so really you’ve lost money the same as any other service would.

Im currently working for a agency i get paid a week in advance i was booked into a shift this morning as soon i arrived i was told it’s been cancelled and they have spoken to the agency i looked at my phone and they texted me literally 10min prior to shift starting 1hour commute + 30miles (1 way trip )down the drain agency said they would pay me 2hours if the company agrees as apparently the truck was down so its the company fault. I usually work 12hours on average at said place and try my best:Anyways agency will pay me 2hours ( i want 5hours min )if company agrees so this is were it get interesting: ( what i want to do )
- Wait 2 weeks so agency have paid me said funds into my bank, then accept a day work at the company get a taxi into work drop the trailer off in a random layby 2hours away from the depo with goods inside ( trailer does not have gps so wont tell them were its parked ) bring unit back near my home address and park it outside the police station and hand the keys in and quit = all in all cost the company 1k for playing me about is there anything legally wrong here? then join a new agency or get a perm job somewhere
2)fuel my car with £50 of company diesel
- do nothing
Im going pick option 1 yay or nay guys.
ps: i cant deal with chasing the agency/company up to small claim court
Only happened to me once, it was 2009 in the Christmas rush. I turned up at the Green death and I got a text through saying I was cancelled as I stood there. The reason was they hadn’t got any spare trucks left . Agency blamed Stobarts, Stobarts blamed Agency. Outcome I didn’t get paid and politely refused anymore work from agency.
There are plenty of other agencies out there (good and bad), you just got to start looking around. Your a prat if you go for option1 or 2, I always say leave on good terms because you may need to go back if you carnt find anything else. we live in funny times at the moment and jobs are getting less by the day.

I don’t think anyone is saying that it is OK - just that it is (as with the flight) a contract subject to the terms and conditions written therein.
I doubt the client company has any contractual obligation to the driver - their contract is with the agency. It is of no concern to the driver whether or not the client pays the agency, as his contract is with the agency, not the client.

In my case I used to get 8hrs pay IF cancelled within 2hrs, then it went to 4hrs pay within 2hrs. But it’s a long while since I’ve seen anyone guaranteed 8hrs for a cancelled shift.
There’s way too many knuckle head agency drivers running around for pennies, the entrepreneurial Ltd Co drivers literally ripped the bottom out of the market and the agencies helped them to the bottom, you need to be PAYE & higher up the pecking order these day to ensure you will get paid for your time should you get cancelled

It’s probably because guys have felt forced to book in a shift they didn’t really want, and have either suddenly got something better, or just couldn’t be bothered getting up for it when it actually came time because the reward and enthusiasm just isn’t there.
