I was reminded of this tonight. Although was basically informed that ‘waiting in the transport office for the job until I was ready to go’ was POA despite them not knowing when I would be ready. :unamused:

Whilst a POA requires a certain degree of knowledge as to how long it is likely to be, a Break doesn’t. Therefore, ‘waiting in the transport office for the job until I was ready to go’, when the time period is unknown, can be counted as Break under the WTR.

The matter of Agencies and Workplace Agreements is something of an anomally as, although the Agency employs (and pays) the worker, the Agency does not control the ‘workplace’. What they have probably agreed is that the Agency will only supply drivers who are willing to enter a ‘Workplace Agreement’ with the customer, and whilst technically, the necessary documentation should be signed, etc, by each new arrival, practicalities and, to a certain extent, common sense, means that this often gets overlooked. :wink:
