Scenario- 6.5t gw truck, 9t gtw

I have different view on this to 2 diferent TMs who are also owner drivers, so no monkeys you’d hope, but I think I’m correct & they are not on this, so your views please, with link to regs if pos.

1- can a (grandfather rights) c1e licence holder (with the 8250kg code 107 restriction) drive this with trailer with laden gtw sub 8250 & thats ok, or does the truck need to be down plated from 9t gtw to 8250kg.

2- (assume regular hgv class 1 driver for this) can the above vehicle empty (ulw 2.8t) tow 3.5t trailer fully laden? Its well under its gtw but if truck runs at full 6.5t gw + the 3.5t trailer it couldn’t stay under the 9t gtw.

Its well under its gtw but if truck runs at full 6.5t gw + the 3.5t trailer it couldn’t stay under the 9t gtw.

no at its max gw it could only tow a trailer weighing 2.5t.

The vehicle has a GVW of 6500
Your C1+E has max total plated MAM weight of 8250
The maximum trailer plated MAM you can tow is 1750

How’s that for simplicity

Vehicle GVW 6500 + GTW 9000
A driver with a C+E could tow a 3500 plated trailer behind it with the trailer fully loaded at 3500 and the van loaded to 5500

GTW refers to the total ACTUAL weight not the total of the plated MAM weights

As the weight laws are the same for cars vans and LGVs then look at this scenario -
Rigid lorry
GVW 32 tonnes
GTW 44 tonnes
Empty 12 tonnes
Max Payload 20 tonnes

Drag trailer
MAM 18 tonnes
Empty 6 tonnes
Max payload 12 tonnes

Total MAM = 50 tonnes but is limited by the GTW to 44 tonnes

Max possible payload is 26 tonnes (44 - 12 - 6 = 26)

How you spread out that 26 tonnes between lorry and drag is up to the driver bearing in mind that a max of 20 can be put on the lorry and a max of 12 can be put on the drag trailer

Not with your yes to Q1 because its the total of the plated MAM weights (vehicle GVW + trailer plated MAM) that must not exceed 8250 not the actual weight (GTW)
