Going home but not at base

Can i ask this.

We all know that if you park your truck away from the operating centre and go home as its only 5 miles away and the wife picks you up and then takes you back you don’t have to count the traveling time as other work.

lets say you work for a company that as got an operating centre in Leeds and you live in Wakefield and the firm parks trucks in a truck park in Wakefield and you live in Wakefield and it take you 15 Min’s to get home would that time be classed as other work even though you always start work there the truck park is not an operating centre.

Would the truck park have to be listed as one of the firms operating centres under the O licence :question:

GVLOA 1995 s.7(3)

…“operating centre” , in relation to any vehicle, means the
base or centre at which the vehicle is normally kept…

This place is mentioned in the ‘O’ licence and any additional ‘bases’ must be notified to the TC for approval under s.8 of the same Act.

In the original question and for full legality, it will depend on the frequency of the overnight stops in Wakefield and a court’s interpretation of the word “normally” from the above quote.

In practice, many drivers have been known to keep their heads down when engaging in this activity, but there can be problems for both the driver and the truck owner for tpeople who leave an ‘O’ licenced truck parked in a place that annoys the neighbours if the truck is parked near houses. The neighbours then might report this to the authorities… :frowning:

IMHO, a truck parked in a legitimate truckpark is unlikely to attract much attention, but one can never be too sure of such things. :wink:

should clarify in relation to the traveling from the truck park to the truck park would that be other work as the truck park is not the companies operating centre.

put an other way say you work in Liverpool and live in Liverpool but your companies O/L in in Brighton, would the traveling time home be counted as other work, the disc in the truck is for Brighton and for this we know there have not declared the operating centre in Liverpool, which is down to them, its just the traveling home bit that interest me, as the base is your normal base

If you are finishing one shift and resuming the next shift in the same place no travelling has taken place, regardless where that place is, whether or not it is an operating centre, or whether you actually stayed in that place for the duration of your rest.

As usual Neil beat me to it, You could park in a lorry park 5 or 500 miles from your base. Your wife could pick you up, or you could walk around the lorry park all night with no sleep.

As long as you book off in X and restart from X, it doesn’t matter, however, if you ring your boss from X and tell him where the truck is and he decides to use it. Then I am sure Neil will be back to explain the consequences :smiley:
