Boss cannot take money from employee unless clearly stated in a contract.

No contract - no money from employee to boss - it’s the law - nice and simple
a contract of employment can be verbal mate it does not have to be right down the only thing is i would say is you are entitled to a written statement of your main employment terms within two months of starting work
and by law no employer can take money out of you pay with out consent and could be prosecuted for doing so and if the company as a policy that you have to pay for the excess it would have to be in the terms and written down for them to do that

When I started my current job I was given a contract of employment with a paragraph stating that I would have to pay any insurance excess in the case of a claim, I refused to sign it and it was taken out of the contract before I signed.
No driver should ever agree to pay insurance excess in my opinion and if it hasn’t been agreed that the driver will pay then surely the company have no right to stop the money

Contract or not an employer cannot withhold legitimat earnings from an employee- no contract means employer cannot prove driver agreed to it
Take the robbing [zb] to an employment tribunal and fight it. I did and won

I know a few of them in the local area, from my experience they are the worst employers.
Each employee is entitled to a written written statement of your main employment terms within 2 MONTHS of starting work-even if you work for them for less than 2 months.This info is available from the directgov website.
Don’t let the COWBOY bosses give you a bum steer- jobs are short I know but if everyone stands up for their rights you can make a difference

You don’t have to get a written contract, basically what you agreed to in the interview before you took the job becomes your contract.
You always have a contract with an employer, even if it’s not in writing. If you buy a Mars Bar you make a legal contract with the shopkeeper.
But with regard to the original question, yes, he would do well to get a better job.
Beggars belief they try and get drivers to pay for damage. Too many accidents equals heave ho but the odd one here and there is par for the course, no ones perfect.

I did. I went to the Employment Tribunal and won every single penny I claimed for…
(recovering the money though is other thing, as company is busted).
Don’t let them rip you off!
As for some particulars: In my contract was that I am responsible for damages done by my bad will or negligence… They claimed on that. But anyway they CAN’T deduct ANYTHING without my written agreement.

Is the wrong answer. By law you have to have a written contract of employment and if you’re not given one, if it ever comes out in a tribuneral then the employee is automatically awarded £1500 regardless of the outcome.

- Asked him where it said in the contract of employment he signed that he was liable for damages.
- Asked him where it says in law that the employer has the right to make deductions from wages without the consent of the employee.
- As he has left, go get the holiday pay. He is legally entitled to it even though he walked out.
