The way I see things, there are two main types of road accident.
One type is a split second misjudgement of a situation (or a developing one) and of this we are all guilty at one time or another.

To drive drunk, to drive whilst texting (a grave sin in my book, much worse than holding a phone to your ear) and to drive full well knowing that you are breaking all the rules and that you will be impaired - these acts are premeditated.
They are all missing something - the number of years in clink doesn’t have a figure 1 in front of it.
Personally, I would have bunged texting bloke 5 years just for trying to pervert the cause of justice by erasing his text and blaming the crash on the chap he just killed.
We all make thousands of decisions every day and we cannot get them all right all of the time - sometimes we screw up and the consequences can be very serious but we didn’t set out to be dangerous.

I don’t know why drivers don’t stand up for themselves anyway, I used to have the persona that truckers were tough and no nonsense and didnt let anyone ■■■■ on them, but really there are a lot of ■■■■■■ out there who just ■■■■■ and whine like a bunch of girls and bend over and get shafted by their employers.
There is running bent to get home once in a blue moon on a Friday evening, and there is just plane running bent by running a business this way.

One of our drivers was involved in this accident. He was waiting to come off at the junction for Tilbury and the services and the next minuite got shunted forward into a car, he looked in his mirrors to see the carnage behind him and got out. He said the old fella was more or less dead straight away he was just gargling and a women driver was trying to comfort him the best she could. His truck was impounded for about 3 month.

And when it returned it was probably writen off, our company had a truck rear ended by another, ours being stationary and the other at 50 ish mile an hour. The Cab was floor and some panels were bent/damaged just by the force off the impact, though 5th wheel was smashed from its position, the trailer hadnt actualy made contact with the cab but the chassis was buckled.
It is quite a surprise that for what appears to be such a large abuse of driver hours rules, which nust have been a factor in the accident, and that the accident included a fatality, and others with life changing injuries, that the setence does appear very laenient. I wonder if it might get refered to the DPP.

actually there was hardly any damage to the unit, mainly on the trailer where it was pushed forward. I think the truck that had hit him was one that had been shunted forward by the one the german driver was in.
