Gatso adjustment?

Just a quick question, sorry if this has been asked before.

Along the A312 as you near bulls bridge roundabout is a Gatso, set at 50, at the moment there are repairs being done to the crash barrier so a 30 limit is in force with 30mph signs, this Gatso is in the section of road works, is it still set at 50 or has it been adjusted to 30mph? the road works have been there for sometime, traffic seems to still proceed at 50mph.

Couldn’t tell, the don’t all flash now, some are infrared, was not sure if permanent Gatsos are adjusted if they happen to be in a section of road works subject to a lower limit?

They can be adjusted to any speed. Best stick to the posted limits and remove any doubts, wouldn’t you say? :wink:

After being caught by a Gatso, or similar, a nip (notice of intended prosecution) must be received by the registered keeper within 14 consecutive days of the offence.

When the RK receives the nip, there is also a form included requiring the driver to be named, this is when the RK will pass the form to who they believe was the driver, the 14 day time limit no longer applies after the first nip was received by the RK (I guess because with a company registered vehicle it might, for example, take 3 or 4 weeks to trace/contact the driver)…

From the RK receiving the first nip there is a further 28 day time limit for nominating who the driver was, it is a legal requirement and failure to do so will incur points and a large fine for that ‘offence’ alone.

Its the camera just before the roundabout for the international market on the a312, I think its called bulls bridge roundabout, bit worried, we use that road a lot to access the lovely cargo “horseshoe” at Heathrow, those barrier repairs seem to be taking ages.

Must admit I stick to 30 through there at the moment
For the extra few seconds it takes to travel that half a mile or so there seems no point rushing.

Why read a website that only gives part of the picture? Why not read the legislation (Sections 1-3 Road Traffic Offenders Act 1988)? This clearly states that a correctly addressed NIP will be deemed to have been served if it is sent by Recorded Delivery or Registered post even if it is returned as undelivered. i.e. You don’t actually have to receive the notice for it to be “served” on you.

I would also refer you to Section 7 Interpretation Act 1978:

“Where an Act authorises or requires any document to be served by post (whether the expression “serve” or the expression “give” or “send” or any other expression is used) then, unless the contrary intention appears, the service is deemed to be effected by properly addressing, pre-paying and posting a letter containing the document and, unless the contrary is proved, to have been effected at the time at which the letter would be delivered in the ordinary course of post.”

The RK (or TM) should NOT pass the NIP to the driver, although many TMs seem to think that is what they should do. The RK should fill in the details of the driver and send the NIP back within the stated time. After that, the driver will get their own NIP which they should complete. In some companies, especially where the RK is in a distant site, the driver may not be NIPped for some time after being flashed.
