If you read my posts you’ll have seen that I actually said the operator had damned himself with his own admission regarding the thing’s condition regardless.I also said that hopefully the judge will make an example of him. :unamused:

It’s a forum.You know a place where people post stuff.Which others either agree with or disagree with or post stuff having no particular view either way.While just ■■■■■■■■ and moaning about anyone posting anything obviously defeats the bleedin object. :unamused:

And if someone from the investigation side , even the Traffic Police had one of these & taken dated timed photos ,just after incident they may have ended up appearing a bit more competent, rather than trying to make assumptions after a good few hours had passed .

Luckily for the driver they weren’t on the jury letting personal grief over shadow justice.Which in this case meant proving beyond reasonable doubt that the defects which damned the operator were also obvious to the driver.

Going to stick my neck out here - I think its only right that Potter was cleared - he simply didn’t know any better and I see him in a way as being involved with someone and something which no doubt he will bitterly regret for a long time.

As for the other two, off to the big house you go and wait for the 27th of next month.

Just as well justice isn’t carried out by victims then. They of all people should understand the driver certainly didn’t get off scot free, he will re-live that horrifying incident probably every day he is left on this earth. I feel for the poor lad to be honest

Ah you already said it. I didn’t read whole thread before commenting. As for going for driving jobs I personally doubt he’ll ever drive a truck again. I probably wouldn’t.

VoSA need to answer the question if slack adjuster reaction brackets are known to fracture occasionally on 8x4 Scanias, then why have they not issued issued Scania with instructions to implement a safety recall?

They have a partial blame imo if as another poster has said, the council KNEW they were lying on the deck.

Cautionary tale for all of us with cutting through width or weight restrictions, if something goes wrong, even though that has nothing to do with the accident it clearly sways juries by implying you play fast and loose with the rules.

If they had actually been delivering down there it wouldn’t have featured in the case at all.

I don’t agree he’s not an innocent victim in the way the deceased are. I agree his age and experience is a mitigating factor but he too originally lied to the police and he is an adult male who took on a job with responsibility.

Someone where I used to work killed a family, after falling asleep at the wheel, and went back to driving. In this case a jury has effectively told him none of it was his fault.

With four people losing their lives due to a runaway truck, surely that is a minor detail. If the driver was inside a width restriction it would only be a fine for him.

It seems as if the blame for this tragedy has rested on the operator, how would width restriction signs not being present bring blame on the Council?

We would into the territory of prosecuting every local authority that didn’t trim hedges back by signs or replace bollard lights, and that isn’t going to happen.

XFMatt on here, also with plenty of encouragement from on here, took on a young inexperienced driver and he put the wagon on its side could easily have been a similar scenario if a family in a car had been next to it.

I agree, that’s my main question mark over the case. The operator was certainly incompetent and out of his depth but the investigation just didn’t really convince on just how criminal the negligence was. The other trucks were ok and he’d spent £6k on parts for the vehicle.

I will tell you how Darkbrain, clearly not enough light penetrates your skull.

IF a council KNOWINGLY fails to replace a sign that RESTRICTS lgv’s in any way, the driver cannot get prosecuted from using that route because there is NO SIGNAGE to indicate otherwise.

You then get unsuitable vehicles going down unsuitable roads, which the whole point in the first place was to avoid because of safety concerns. Sounds like potential partial blame to me.

So are some people born as middle aged lorry drivers with 20 years experience then

I’d imagine the operator may regret his disregard of maintenance and the law a bit more now
