During a discussion this week,i"ve confused myself(easy i know).
in all my driving career,i have done my fortnightly driving hours “en bloc”,where i use a “week one i drove 48 hours ,so that leaves me 42 hours for week 2”,for example.i then “reset” my driving hours for week"3",which i then count as week “1” again.so i then have 90 hours for the coming fortnight.
i"ve never been pulled on tacho infringments,using this method.
another driver says im wrong,and that the fornightly driving is “rolling”,ie week “1” if you drive 48 hours,then week “2” you drive 42 hours,week “3” you can drive 48 hours.
who is right and who is wrong,or do they amount to the same anyway??

I think you are wrong, as the rules say 90 hours driving in any 2 consecutive weeks.
So if you do 40 hours in week 1, 50 hours in week 2 then only 40 hours is available for week 3 etc
I bet the answer will be explained in better ways than this by a man who can.

The fortnightly driving limit is a rolling fortnight ie any two consecutive weeks
The maximum allowed driving in any week is 56 hours.
In any two consecutive weeks you can drive for a maximum of 90 hours.
Example 1:
Week 1 - Drive for 42 hours.
Week 2 - Drive for 48 hours. (weeks 1 and 2 should total no more than 90 hours driving)
Week 3 - Drive for maximum of 42 hours. (weeks 2 and 3 should total no more than 90 hours driving)
Example 2:
- Week 1 - ?
- Week 2 - Neither weeks 1 and 2 OR weeks 2 and 3 should total no more than 90 hours driving.
- Week 3 - Neither weeks 2 and 3 OR weeks 3 and 4 should total no more than 90 hours driving.
- Week 4 - Neither weeks 3 and 4 OR weeks 4 and 5 should total no more than 90 hours driving.
- Week 5 - Neither weeks 4 and 5 OR weeks 5 and 6 should total no more than 90 hours driving.
- Week 6 - Neither weeks 5 and 6 OR weeks 6 and 7 should total no more than 90 hours driving.

You are never driving in week 1 or week 2 - if you think of it that way then you will be caught out in the way that you have been.
I’ll expand on the above -
Think of it this way - you have 90 hours to use over any 2 consecutive weeks (that is any 2 week, back to back, period)
After a one week holiday (easy place to start) you do 50 in the first week - that leaves you 40 max for next week as you did 50 in this week (50 + 40 = 90)
Second week you do 35 which is ok as it is under 40 - that leaves you 55 max for next week as you only did 35 in this week (35 + 55 = 90)
Third week you do 48 which is ok as it is under 55 - that leaves you 42 max for next week becauase you did 48 in this week (48 + 42 = 90)
Fourth week you do 38 which is ok because it is under 42 - that leaves you 52 max for next week as you did 38 in this week (38 + 52 = 90)

Doesn’t matter, there is nothing in the tacho rules which relies on there being a week 1, week 2 etc. All that matters is that at any time the total driving for the current week and the previous week doesn’t exceed 90 hours.
You do see Week 1, Week 2, Week 3 and so on, being used in this forum in answer to peoples questions but that is only in an effort to make explanations of weekly rest requirements, total driving hours etc a bit clearer and the week numbers have no actual bearing on the rules.

Hi buck73, you might be going wrong by thinking of the weeks in “sections.”
The rule is any two consecutive weeks, so that means this week and last week (90hrs total,) but it ALSO means this week and next week (90hrs total.)
To write it in an even shorter form: you can’t drive for more than 90 hours in ANY two consecutive weeks.

count up your hours for each week = 45 in the next week you can only drive a max 45 hrs
if you drive less then the following week you can extend your driving but any ajoining 2 weeks must be 90hrs or less
… 45+45=90
so 45+40=85
so 40+35=75
so 35+55=90
so 55+35=90
so 35+45=85
so 45+45=90
