It’s probably the EU law that is actually causing it. The article says that both UK and EU drivers would be liable for a £30 graduated fine if found to be driving without a card. It’s only if further investigation finds that the driver doesn’t have one at all or has been caught without it before that the higher fines and penalties kick in, but because the authorities won’t be able to check whether foreign drivers actually hold the card they will essentially be unable to fine them more than the basic fine. Just another example of how the whole thing has been badly thought out and implemented.
I don’t agree with roadside fines or deposits.
The last two i’ve had in the UK were unlawful and got dropped. The police couldn’t understand the leaglities of a ferry movement, and vosa couldn’t understand that there is a difference between 7 calender days and 7x24 hour peiods.
A foreign driver has to pay up there and then. He has very little chance of arguing his case.

they don’t impose huge fines at all, you have to be found guilty of an offence before you can be fined, what they do is require a deposit which will be returned if and when you attend court and are found not guilty.
of course the are fully aware that it will cost you more to attend court in their country and acquire a lawyer to defend you so normally the deposit gets forfeited

Totally agree had to pay some big fines for small offences and they wont give you your papers back until you pay.
Why can they not stop a foreign driver from the entering the UK on a future visit, if he has been fined and fail to show at court. Or, send the fine to the company.

Is it right to persecute someone because of their nationality or job they do?
Is he supposed to stay in the UK and await his court date? or should he be forced to fly to the UK to make a plea, then fly home, then back again etc etc?

If by persecution you mean, someone who has committed an offence, and failed to turn up for court, then yes. The driver will have knowingly entered the UK without have the legally required DCPC, it is their fault. They will have to prove otherwise, like everyone else, in court, if they turn up.
As I said, if they fail to turn up at court, stop them from entering the country until the fine is paid.
It’s not persecution, and it isn’t xenophobic - it’s everyone singing from the same hymn sheet.
I think this is fairer than VOSA demanding payment upfront as do other EU countries.

just because vosa or the police claim that someone has commited an offence dosn’t mean they are guilty.
