Ferry delays – tacho / hours

If you get caught up in Operation Stack, what do you do about driving hrs etc?

Does the M20 become a lorry park, so you can take a break (or long break or even daily rest !?!).

I should imagine a lot of drivers take the card out.

What do you reckon?

I don’t have an account with the Tunnel — apparently they want £750 for non quota traffic !

If I book Norfolk Line to Dunkirque, would I still be put in the stack?

If the delay is 9hrs or11hrs this is a complete rest period. if the

delay is let us say between 1hr and 7hrs you can use it towards

your rest period. If the waiting time is 8 hrs you can use this plus

a total of another 4hrs which makes arest period of 12hrs which is also

a legal period, the 4hrs must not be less than 1hrs duration at any time,

IF the delay is only 30mins you can use it as a normal part of a break.

I think as these delays at the port of DOVER–CALAIS has been

publicized and put out on the TV and RADIO you may have a problem

as it is a known about delay, I may be wrong in this and some

one might be better informed as myself,

the docks ,or the road is closed and there is a traffic-jam. this is

allowed to be acounted for on the reverse of the TACHO and used

when applicable, as per the rules and reg,s for lorrydrivers,

You can count them but you need to take a 4 plus 8 not an 8 plus 4

I think the reason they use operation stack is just to stop all the traffic blocking dover town up and spoiling the view of the seafront for the illegal immigrants, so It doesnt matter whether you are going to Dunkirk or Calais.

And be prepared to be turned back and sent to the end of the queue if you try to use Jubilee Way :blush:

so in my books it is possible to do this,but I willing to be corrected if

The 8 hour period must be taken at the end of the working day

The EC rules allow the daily rest period to be split. This split must contain a minimum period of 8 consecutive hours rest which must be taken at the end of the working day, plus a further 4 hours (ie, 12 hours in total in the 24 hour period) which may be taken at any point during the working day either as a single 4 hour period, or split into other periods of not less than 1 hour (ie. 2+2 or 1 + 3hrs).

I have read and digested this, my excuse is I was reading the regs
from the print out from my local hse office here in germany and this point is not shown only the written statement of taking the rest in the 24hr

Yes your right,but this is a goverment agency which has printed the
form .from which I took the statement off,
So it shows that some where is a big mistake in the interpretation of
the rules and regulations on behalf of some one. Whose is the one
which is at fault,VOSA:GB OR the HSE FROM germany, I will try to
get into the BAG website and see what they have written down and
see what they say.

I was on the site from the BAG it also not correct, and to-day I spoke to
one of the HSE officers here in Dortmund and explained the problem.
He said they have made a mistake in the way that ,the regulations were
printed and he confirmed ,that the answer you stated wheelnut was right
and theirs was wrong, So some one is in for it as he is going to check
the site from BAG;;
