Exemption Rules

Morning, I have agency work for 4 weeks and it is with a water company who specialise in sewerage, I will be on call this weekend incase there are floodings or blockages, they get call outs for emergency sewerage maintenance and work through the night. if I am on emergency work what do I put down on the digi? Out of scope? Not come across this as a new driver, I can’t recall any of this in any of the CPC’s, i mean it might not even happen, but I would like to be prepared incase I get the call aye, it’s all a bit confusing. cheers

Put the tachograph on “Out of Scope”, I’m assuming you don’t use log books but if you do you don’t need to use your driver card.

Eu regs exemptions

Vehicles used in connection with sewerage, flood protection, water, gas and electricity maintenance services, road maintenance or control, door-to-door household refuse collection or disposal, telegraph or telephone services, radio or television broadcasting and the detection of radio or television transmitters or receivers.
There have been a number of significant court rulings from the European Court of Justice and British courts dealing with this exemption. Common themes have included a direct and close involvement in the exempt activity; the principle of a general service in the public interest; and the limited and secondary nature of the transport activity.

It’s DVSAs view that vehicles used in connection with sewerage, flood protection, water, gas and electricity services must be involved in the maintenance of an existing service (rather than the construction of a new service) to claim the concession.

That means you are on domestic regs so tacho on out of scope
