When carrying fire extiguisher’s, do they have to be in a proper box fitted to vehicle by law ?

I might be dull, but I always thought that its policeman job to prove you are guilty, not your job to prove that you are not a camel…

There is a law saying these items need to be inspected. The inspection will be confirmed with a sticker. No eveidence to prove otherwise, i assume means no inspection sticker.
To be honest the HSE law (or the laws they enforce) bear no resembalance to how other laws are enforced. For example you (as an employer) would not get a fine for not training your driver to use his tail lift. But if he has an accident and he’s had no training, you would. Its like a ‘retrospective’ type law. Bizzare !

It applies to everyone, not just ADR its called PUWER, the Provision and Use of Work Related Equiptment Regulations. And if you look at it it’ll make your toes curl !!!

Ilive in Spain (Canary islands) we have to by law carry fire extinguishers and have the paperwork up to date,ie checked yearly.

In this country the police present any evidence found during such inspections to the Crown Prosecution Service who decide whether or not to bring a prosecution, VOSA on the other hand, have their own prosecutions department & bring their own cases to court.

Our ADR vehicles have to carry a certain number of extinguishers. One of our ADR drivers, returning empty to base early one morning, witnessed a bad RTA. He used his cab extinguisher, and one of the coppers on scene gave him a written note to explain to whoever else might stop him why the extinguisher was discharged. Otherise he’d have been in trouble if stopped.

Too many rules, everyone knows if you’re on ADR, it’s because the goods are DANGEROUS, so if there’s a fire, you run like ■■■■

I would suggest the driver of the A Rose (Newark) Ltd vehicle was stopped by VOSA and for whatever reason failed the attitude test.
